(a) The city shall promptly pay for the completed delivered goods or services by the <br />required payment date. The required payment date shall be either: <br />(1) The date on which payment is due under the terms of the contract for the <br />provision of such goods or services; or <br />(2) If such date is not established by contract, not more than 45 days after goods or <br />services are received or not more than 45 days after the invoice is rendered, <br />whichever is later=. except in the instances where the source of the fundine for <br />the contract is the state or federal government In such instances the payment <br />date shall not exceed 30 days Separate payment dates may be specified for <br />contracts under which goods or services are provided in a series of partial <br />executions or deliveries to the extent that the contract provides for separate <br />payment for partial execution or delivery. <br />10. Subsection (a) of Section 12-212 of the Code of the City of Portsmouth, Virginia <br />(2006) is amended as follows: <br />Sec. 12-212. -Requirements for certain state-aid construction contracts. <br />(a) No contract for the construction of any building or for an addition or improvement of <br />an existing building for which state funds of not more than $30,000.00 in the <br />aggregate or for the sum of all phases of a contract or project either by appropriation, <br />grant-in-aid or loan are used or to be used for all or part of the cost of the <br />construction shall be let except after competitive sealed bidding; except that <br />competitive negotiation may be used for construction contracts in the following <br />instances, upon a determination made in advance by the purchasing administrator <br />and set forth in writing that competitive sealed bidding is either not practicable or <br />not physically advantageous to the public, which writing shall document the basis <br />for this determination: <br />` t- ,.t_ <br />X11 r_n.. a... ,.,~,. ,.~: _~~ z~a~~', ~'€~@®~--®~®~i~@~~a: _ ~ <br />~ ~ <br />(1~)For the construction of highways and any drainage, dredging, excavation, <br />grading or similar work upon real property; or <br />(23<) As otherwise provided in Code of ViYginia, § 2.2-4308. as amended. restated or <br />moved from time to time. <br />9 <br />
