~i~ ~<'d~ t - _._ AN ORDINANCE AMENDING SUBSECTION 9-26(A) OF CHAPTER 9 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (2006) TO `DEFINE THE TERM "MOUNT CALVARY CEMETERY COMPLEX". WHEREAS, City Council adopted Ordinance 2014-82 on September 23, 2014 (the "Prior Ordinance") for the purpose of amending Chapter 9 of the Code of the City of Portsmouth, Virginia (2006) to officially designate Mount Calvary Cemetery, Fisher's Hill Cemetery, the Pauper's Field Cemetery, and Mount Olive Cemetery as City cemeteries under the general defined term "Mount Calvary Cemetery Complex"; and WHEREAS, the Prior Ordinance amended Subsections 9-26(b) and 9-29(a) of the City Code to designate the Mount Calvary Cemetery Complex as City cemeteries and to provide for their perpetual care by the City, but inadvertently did not amend Subsection 9-26(a) to define the term "Mount Calvary Cemetery Complex"; NOW THEREFORE BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That subsection 9- 26(a) of Chapter 9 of the Code of the City of Portsmouth, Virginia (2006) be amended and reordained to read as follows: Sec. 9-26. Burial grounds, city cemeteries designated. (a) The burial ground at Glasgow Street and Fort Lane shall be known as "Cedar Grove Cemetery." The burial ground at London Boulevard and Peninsula Avenue shall be known as "Oak Grove Cemetery." The burial grounds adjoining City Park and Clifford Street shall be known as "Olive Branch Cemetery," and "Olive Branch Annex Cemetery." The burial ground located on Pulaski Street in the Prentis Park neighborhood shall be known as the "Mount Calvary Cemetery Com lex" and shall include Mount Calvary Cemetery Fisher's Hill Cemetery the Pauper's Field Cemetery and Mount Olive Cemetery 2. That this ordinance shall take effect on the date of its adoption. ADOPTED by the Council of the City of Portsmouth, Virginia at a meeting held on August 23, 2016. Teste: City Clerk
