amendment of the aforementioned section by the legislature of the state shall be <br />deemed to be incorporated herein upon the effective date of such legislation. <br />(f) While on the property of its owner, an animal found by a court to be a dangerous <br />dog shall be confined indoors or in a securely enclosed and locked structure of <br />sufficient height not less than -six feet with a secure top and designed to prevent its <br />escape or direct contact with or entry by minors, adults or other animals. The <br />structure shall be designed to provide the animal with all the elements of basic <br />animal care as enumerated in Code of Virginia, §3.2-6503. When off its owner's <br />property, an animal found by a court to be a dangerous dog shall be kept on a <br />leash and muzzled in such a manner as not to cause injury to the animal or <br />interfere with the animal's vision or respiration, but so as to prevent it from biting <br />a person or another animal. Such muzzle shall be approved by the animal control <br />officer. <br />(j) All fees collected pursuant to this section, less the cost incurred by the animal <br />control authority in producing and distributing the certificates and tags required <br />by this section, shall be paid into a special dedicated fund in the treasury of the <br />city for the purpose of paying the expenses and any training course required under <br />Code of Virginia, §3.2-6556, which section is incorporated herein by reference, it <br />being the intent of this section that any amendment to the aforementioned section <br />by the legislature of the state shall be deemed to be incorporated herein upon the <br />effective date of such legislation. <br />7. That subsection (b) of Section 4-74 of the Code of the City of Portsmouth, <br />Virginia (2006) is hereby amended as follows: <br />Sec. 4-74. -Records, reports and audit of license sales; destruction of unsold tags, <br />and disposition of funds. <br />(b) The city treasurer shall deposit all funds collected for dog license taxes into the <br />general fund of the city. The city shall use the funds for the following purposes: <br />(1) The salary and expenses of the animal control officer and necessary staff; <br />(2) The care and maintenance of a dog pound; <br />(3) The maintenance of a rabies control program; <br />(4) Payments as a bounty to any person neutering or spaying a dog up to the <br />amount of one year of the license tax as provided by ordinance; <br />(5) Payments for compensation as provided in Code of Virginia, §3.2-6553; <br />and <br />(6) Efforts to promote sterilization of dogs and cats. <br />Any funds unexpended for such purposes on December 31st of any year, will remain in <br />the general fund of the city. <br />4 <br />
