rights in such animal and has read and signed a statement as required by <br />subsection (e) of this section. However, any feral animal not bearing a collar, tag, <br />tattoo, or other form of identification which, based on the written certification of a <br />disinterested person, exhibits behavior that poses a risk of physical injury to any <br />person confining the animal, may be euthanized after being kept for a period of <br />not less than three days, at least one of which shall be a full business day, such <br />period to commence on the day the animal is initially confined in the facility, <br />unless sooner claimed by the rightful owner. The certification of the disinterested <br />person shall be kept with the animal as required by Code of Virginia, §3.2-6557. <br />For the purposes of this subsection, a disinterested person shall not include a <br />person releasing or reporting the animal to the facility. During the period of <br />impoundment, the animal may be redeemed by paying to the attendant at the <br />pound the amount set out in appendix A to this Code for the first day and the <br />amount set out in appendix A to this Code for each additional day or any part <br />thereof to cover the actual expenses incurred in keeping the animal impounded <br />and by exhibiting to the person in charge of the pound the receipt for the license <br />tax required to be paid by this chapter. All such impounding fees shall be paid <br />over to the city treasurer monthly. <br />(d) Disposal. If not redeemed within the time periods provided for in subsection (c) <br />of this section, an animal impounded pursuant to this section shall be disposed of, <br />other than by sale, by the Portsmouth Humane Society, Inc or other entity serving <br />as the city's public animal shelter. <br />6. That subsections (b), (fj and (j) of Section 4-33.1 of the Code of the City <br />of Portsmouth, Virginia (2006) are hereby amended as follows: <br />Sec. 4-33.1. -Authority to control dangerous or vicious dogs. <br />(b) Any animal control officer who has reason to believe that a canine or canine <br />crossbreed within his jurisdiction is a dangerous dog or vicious dog shall apply to <br />a magistrate of the city for the issuance of a summons requiring the owner or <br />custodian, if known, to appear before the general district court at a specified time. <br />The summons shall advise the owner of the nature of the proceeding and the <br />matters at issue. The animal control officer or owner shall confine the animal until <br />such time as evidence shall be heard and a verdict rendered. The court, through its <br />contempt powers, may compel the owner, custodian or harborer of the animal to <br />produce the animal. If, after hearing the evidence, the court finds that the animal <br />is a dangerous dog, the court shall order the animal's owner to comply with the <br />provisions of this section. If, after hearing the evidence, the court finds that the <br />animal is a vicious dog, the court shall order the animal euthanized in accordance <br />with the provisions of Code of Virginia, §3.2-6562, which said section is <br />incorporated herein by reference, it being the intent of this section that any <br />3 <br />
