(h) Only the Portsmouth Humane Society or other entity serving as the city's public <br />animal shelter is authorized to keep such lost or stray animals for any period in <br />excess of seven days. <br />4. That subsection (d) of Section 4-13 of the Code of the City of Portsmouth, <br />Virginia (2006) is hereby amended as follows: <br />Sec. 4-13. - Confinement of vicious or destructive animals. <br />(d) Any animal not redeemed within five days of disposition of the original charge by <br />the court shall be disposed of other than by sale or transfer by the Portsmouth <br />Humane Society, Inc or other entity serving as the city's public animal shelter. <br />5. That subsections (a)-(d) of Section 4-32 of the Code of the City of <br />Portsmouth, Virginia (2006) are hereby amended as follows: <br />Sec. 4-32. -Impoundment when running at large. <br />(a) Required. It shall be the duty of the animal control officer to catch and turn over <br />to the Portsmouth Humane Society, Inc. or other entity serving as the city's public <br />animal shelter; for impounding any animal found off the owner's premises, in <br />violation of Section 4-31. <br />(b) Identification and return. If an animal is impounded pursuant to subsection (a) of <br />this section it shall be the duty of the animal control officer and the Portsmouth <br />Humane Society, Inc. or other entity serving as the city's public animal shelter; to <br />make a reasonable effort to ascertain if the animal has a tag, license, tattoo or <br />other identification. If such identification is found, a reasonable effort shall be <br />made to return the animal to its owner or to place the animal for adoption before <br />humanely destroying it. <br />(c) Duration, redemption. Every animal impounded pursuant to subsection (a) of this <br />section shall be penned for five days, except that any impounded animal whose <br />owner is identified shall be held for an additional five days. Such period shall <br />commence on the day immediately following the day the animal is initially <br />confined in the facility of the Portsmouth Humane Society or other entity serving <br />as the city's public animal shelter. During the period of impoundment, the animal <br />may be: (i) redeemed by the rightful owner, (ii) adopted by a resident of the city <br />for which the pound is operated who will pay the required license fee, if any, on <br />such animal, if the animal's rightful owner has surrendered all property rights in <br />such animal and has read and signed a statement as required by subsection (e) of <br />this section, or (iii) adopted by a resident of an adjacent political subdivision of <br />the commonwealth, if the animal's rightful owner has surrendered all property <br />2 <br />
