(h) Only the Portsmouth Humane Society or other entity serving as the city's public animal shelter is authorized to keep such lost or stray animals for any period in excess of seven days. 4. That subsection (d) of Section 4-13 of the Code of the City of Portsmouth, Virginia (2006) is hereby amended as follows: Sec. 4-13. - Confinement of vicious or destructive animals. (d) Any animal not redeemed within five days of disposition of the original charge by the court shall be disposed of other than by sale or transfer by the Portsmouth Humane Society, Inc or other entity serving as the city's public animal shelter. 5. That subsections (a)-(d) of Section 4-32 of the Code of the City of Portsmouth, Virginia (2006) are hereby amended as follows: Sec. 4-32. -Impoundment when running at large. (a) Required. It shall be the duty of the animal control officer to catch and turn over to the Portsmouth Humane Society, Inc. or other entity serving as the city's public animal shelter; for impounding any animal found off the owner's premises, in violation of Section 4-31. (b) Identification and return. If an animal is impounded pursuant to subsection (a) of this section it shall be the duty of the animal control officer and the Portsmouth Humane Society, Inc. or other entity serving as the city's public animal shelter; to make a reasonable effort to ascertain if the animal has a tag, license, tattoo or other identification. If such identification is found, a reasonable effort shall be made to return the animal to its owner or to place the animal for adoption before humanely destroying it. (c) Duration, redemption. Every animal impounded pursuant to subsection (a) of this section shall be penned for five days, except that any impounded animal whose owner is identified shall be held for an additional five days. Such period shall commence on the day immediately following the day the animal is initially confined in the facility of the Portsmouth Humane Society or other entity serving as the city's public animal shelter. During the period of impoundment, the animal may be: (i) redeemed by the rightful owner, (ii) adopted by a resident of the city for which the pound is operated who will pay the required license fee, if any, on such animal, if the animal's rightful owner has surrendered all property rights in such animal and has read and signed a statement as required by subsection (e) of this section, or (iii) adopted by a resident of an adjacent political subdivision of the commonwealth, if the animal's rightful owner has surrendered all property 2
