Comprehensive Environmental Response, Compensation and Liability Act of 1980, as amended <br />from time. to time, and regulations promulgated thereunder; (c) any oil, petroleum products and <br />their by-products, other than those used in automotive or recreational activity, .boats ar <br />motorcycles which are stored on the Premises in accordance with all applicable laws and minor <br />leakage and spills which are, upon. written request of Lessor, promptly clealzed up; and {d) any <br />substance'that is or becomes regulated by any federal, state, or local governmental authority. <br />Lessee hereby agrees that it shall be fully liable for all casts and expenses related to the <br />use, storage and disposal of Hazardacis Material kept on the Premises by the Lessee, and the <br />Lessee shall give immediate notice to the Lessor of any violation or potential violation of the <br />provisions of this section. <br />12. ~IDNDEII'INATI~N. If all or a part of the Premises sufficient to render same <br />unusable for Lessee's purposes {in Lessor's reasonable judgment) ar all means of access to the <br />Premises shall be condemned for a period in excess of 30 days ar sold under threat of <br />condemnation, this Lease shall terminate and Lessee shall have no claim against Lessor for the <br />value of any unexpired Term of this Lease. <br />13. DETiAiJLT AND I~Ii!IEDIES. If Lessee defaults in the performance of any <br />covenant of this Lease after written notice is given to Lessee, ar, if Lessee fails to perform any <br />obligation of Lessee under this Lease and such .default continues after written notice thereof is <br />given to Lessee, ar, if Lessee vacates the Premises, then Lessor shall have the following rights <br />and remedies: <br />{a) Lessor may .terminate this Lease by giving l 0 days written notice to <br />Lessee, in which event this Lease, all rights of Lessee, and all duties of Lessor shall cease, and <br />Lessor may re-enter and take possession of the Premises, remove all persons and property from <br />the Premises and if necessary store Lessee's property in a public warehouse or elsewhere at the <br />cost of Lessee. <br />(b) If Lessor elects. to re-enter the Premises but does not terminate the Lease, <br />Lessor may, at any time thereafter, elect to terminate this Lease by giving written notice to <br />Lessee of such election. Lessor may, at its option, re-let the Premises. <br />(c) In .addition toall remedies specified in this Lease, Lessor shall have all <br />remedies available pursuant to applicable7aw. <br />14. TERMINATION BY LESSQR. If at any time it is deemed to be in the best interest <br />of the Lessor to terminate this Lease prior to the end of any Lease year, Lessor shall give .Lessee <br />as much notice as passible and at least THIRTY (30) days written notice before terminating the <br />Lease. Should the Lessor terminate the Lease during a school year, it will use its best efforts to <br />either allow the Lessee to continue to use the premises until the end of that school year, or, <br />accommodate the athletic activities'at another location until the end of that school year. <br />If at any time the Lessee. is in breach of the provisions of this Lease and after having <br />received notice of the breach from the Lessor, Lessee refuses to cure .same within a reasonable <br />time period, then Lessor may terminate this Lease without further recourse to the Lessee. <br />
