ALTERATI®1`tS TiJ PREIYIISES, Lessee shall not make any structural alterations <br />to the Premises without obtaining Lessor's prior written permission. Any and all structural <br />alterations, additions, or other improvements that have been made by Lessee, with or without the <br />consent of Lessor, regardless of low attached {except movable trade fixtures}, shall become <br />upon installation and thereafter remain the property of Lessor, without compensation to Lessee. <br />However, Lessor shall have the right to xequire that. Lessee, upon the tenninatian or at the <br />expiration of this Lease, remove any ar all such alterations, additions and improvements and <br />restate the Premises to their original condition, normal wear and tear excepted. <br />8, SUBLEASING AND .d-SSIGIVIVIEI`1T. Lessee may not assign its rights under this <br />Lease without the prior written consent of Lessor. <br />9. CAIt.E CDF P.IZEIVIISES. Lessee agrees to take good care of the Premises, and shall <br />not suffer or permit any waste ar injury thereto. Upon the expiration ar termination of this <br />Lease, Lessee shall surrender the Premises in as good condition as Lessee obtained same an the <br />Commencement. LIAI~ILITY, INSURANCE A1VD HOLD HAFt1YILESS. <br />Lessee and its agents: shall be liable for injury to persons andor lass ar damage to property <br />resulting from the negligence ar willful misconduct of Lessee, its agents and employees. Lessee <br />shall notify Lessor promptly of any accident ar loss on the Premises. <br />General Insurance .Requirements: <br />The Lessee shall procure and maintain, at its awn expense, and with a company ar companies <br />acceptable to the Risk Administrator, the minimum insurance coverage's set Earth below. The <br />insured's insurance company shall be rated. "A" ar above by a major rating agency and <br />authorized to da business in Virginia. The Lessee shall notify the Lessor of cancellation of the <br />insurance and procure another policy which complies with these terms and conditions. <br />The City ofFortsmouth, VA including its elected and appointed officials, employees,.and <br />volunteers shall be named as an "Additional Insured" and the required insurance coverage shall <br />be primary coverage and provide contractual liability coverage. The Lessee shall provide a <br />Certificate of Insurance to the City along with a copy of the. Additional Insured Endorsement. <br />Failure by the Lessee to provide the Certificate and Endorsement may constitute grounds for <br />termination of this Lease for default. <br />Additional Insured iteeluirement: <br />The Lessee shall name the fallowing as "Additional Insured" as stipulated herein: <br />"The City of Portsmouth, including its elected and appointed officials, employees, and <br />volunteers shall be named as an additional insured and the required insurance coverage <br />shall be primary coverage and provide contractual liability coverage.
