ELLICIT°T' AVENUE ATI3LETIC FIELID LEASE <br />TI<IIS LEASE (tlae "Lease"} is .made as of , 2014, by and between the <br />BILTMORE BAPTIST CHURCI-I for PORTSMOUTH CHRISTIAN SCHOOLS (hereinafter <br />the "Lessee"), and the CITY OF PORTSMOUTH (hereinafter the "Lessor"}, the parties hereto. <br />1. DESCRIPTION (~F PREMISES. Lessor, for and in consideration of the covenants <br />to be kept and performed and rents to be paid by Lessee and other promises of Lessee contained <br />herein, does hereby Lease to Lessee the Premises described belaw (the "Premises'"}: <br />Athletic Field located at 3120 Elliott Avenue, Portsmouth, Virginia. (See <br />Exhibit A site map} <br />2. 'T'ERM. The initial-term of this Tease (the "Term") shall be for a period of five years, <br />.v]}ich shall commence on August 1, 2014, (the "Commencement Date"}, and end. no later than <br />July 31, 2019, unless sooner terminated by the parties in accordance with the terms of this Lease, <br />or written amendments thereto. This Lease may be renewed 6y mutual written agreement of tl~e <br />parties for up to five additional years. <br />3. RENT and UTILITIES. Lessee agrees to pay Lessor, without demand annual rent of <br />$I.00 and sha1C pay for all utilities and arrange for its own accounts at the premises. <br />4. ACCEPTANCE OF PREMISES. Occupancy of the Premises by Lessee shall <br />constitute its acceptance ofsame. <br />5. USE, FVIAINTENANCE ANl? REPAIRS. The Premises shall be used for <br />recreational and athletic purposes, and for no other purposes without Lessor's prior written <br />consent. Lessee shall use tlxe property according to the Schedule of Activities attached hereto as <br />Exhibit B. Lessee further agrees that Lessor shall have the right to use the premises and have <br />access to the premises throughout the term(s) of this Lease at all times which do not interfere <br />with the Schedule ofActivities in Exhibit B. <br />Lessee covenants that it will be solely responsible for all maintenance and cleanup of the <br />premises and surrounding property and shall abide by all laws of the Commonwealth and <br />ordinances of the City regarding tl~e lease and upkeep of the premises. <br />Lessee further agrees that it will be responsible far making all repairs to the premises and <br />immediately remedying any condition found to be a hazard at the premises, from whatsoever <br />cause, including but not limited to damage caused by the Lessee, its employees, students, guests, <br />invitees, ar the general public, or by acts of God. <br />6. PUBLIC ACCES'S AND USE. The Lessee understands and agrees that the premises <br />shall be available for public use at all times other than when the Lessee. has scheduled use in <br />accordance with Exhibit B, or, times that the premises cannot be used due to maintenance or <br />repairs by the Lessee: The Lessee is responsible for providing .public. access to the field via the <br />pedestrian gate at the southwest corner of the premises, wlZere the lessee shall post a sign stating <br />
