Parcel 2. IT BEING all that certain property conveyed to the <br />Economic Development Authority of the City of Portsmouth, <br />Virginia by Deed from the City of Portsmouth, Virginia dated <br />March 16, 2007 and recorded in the Clerk's Office of the <br />Portsmouth Circuit Court as Instrument Number 070006292. <br />3. That the subject property shall be subject to the following conditions as <br />proffered by the applicant for rezoning: <br />(a) Use of the property shall be limited to those uses permitted in the <br />NMU, Neighborhood Mixed Use district of the Zoning Ordinance, <br />with the exception of the following uses, which shall be prohibited: <br />• Live/Work dwellings <br />• Multifamily dwellings other than Assisted Living. <br />• Any type of single family dwelling <br />• Dormitory <br />• Fraternity or sorority home <br />• Group home <br />• Boarding house <br />• Stand alone blood/tissue collection facilities and drug or <br />alcohol treatment facilities <br />• Stand alone psychiatric treatment facilities <br />• Halfway house <br />• Correctional facilities <br />• Social or fraternal clubs/lodges <br />• Helicopter landing facilities <br />• Passenger terminal, surface transportation <br />• Adult bookstores, adult entertainment establishments or adult <br />theaters <br />• Outdoor marinas <br />• Convenience store <br />• Flea markets <br />• Vehicle sales, rental or service areas <br />• RV Parks <br />• Fuel/oil storage <br />• Outdoor storage as a principal use, and <br />• Recycling drop off centers. <br />(b) Development of the southern portion of the property shall be <br />generally consistent with the Conceptual Master Plan prepared by <br />Land Planning Solutions and dated December 20, 2013, except for <br />modifications and revisions required during site plan review and <br />approval to comply with City ordinances and requirements, or <br />other modifications approved by the Planning Director. <br />
