<br />~ <br /> <br />uRUU~At~CE tI02..?22.:2: <br /> <br />AN ORDINANCE TO AMEND CHAPTER 16 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (2006) BY AMENDING SECTIONS 16-1, 16-9, 16-32, 16-33 <br />AND 16-36 THEREOF PERTAINING TO GARBAGE AND REFUSE. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. That Section 16-1 of the Code of the City of Portsmouth, Virginia (2006) be <br />amended by adding the definitions of "Approved container" and "Recyclables" to read as <br />follows: <br /> <br />Sec. 16-1. Definitions. <br /> <br />The following words, terms and phrases, when used in articles I and II of this chapter, <br />shall have the meanings ascribed to them in this section, except where the context clearly <br />indicates a different meaning: <br /> <br />Approved container means a storage and collection receptacle or container required for <br />the storage and collection of solid waste or recyclables issued by the city and used in the <br />automated solid waste collection program. <br /> <br />Recyclables means items, including but not limited to, newspapers, cardboard, junk mail, <br />and catalogs, papers; clear glass bottles and jars; plastic containers #1 and #2; aluminum cans, <br />aluminum foil and steel/tin food cans. <br /> <br />2. That Sections 16-9, 16-32, 16-33 and 16-36 of the Code of the City of <br />Portsmouth, Virginia (2006) be amended and reordained to read as follows: <br /> <br />Sec. 16-9. Picking over, sorting, etc., garbage, refuse, etc. <br /> <br />It shall be unlawful for any unauthorized person to sort or remove any garbage, trash, <br />litter, refuse, or rubbish from trash or recycling receptacles on the streets of the city, or rake, <br />pick, sort over or gather material from any place where garbage, trash or refuse is dumped or <br />distributed in the city. <br /> <br />Sec. 16-32. Type of containers required. <br /> <br />(a) For areas receiving automated refuse and recycling collection it shall be unlawful for <br />garbage or trash to be set out for collection unless the same is placed in an approved <br />container furnished by the city. <br />
