ORDINANCE tiO.,.2Q)3::~1 AN ORDINANCE TO AMEND CHAPTER 30 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (2006) BY AMENDING SECTIONS 30-117(a) AND 30-119(a), AND BY REPEALING SECTION 30-133, ENTITLED "SOCIAL SECURITY BENEFITS," TO ELIMINATE THE "SOCIAL SECURITY OFFSET" REDUCTION OF BENEFITS FOR RETIREES UNDER THE PORTSMOUTH SUPPLEMENTAL RETIREMENT SYSTEM. BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That Sections 30-117(a) and 30-119(a), of the Code of the City of Portsmouth, Virginia (2006) be amended and reordained to read as follows: Sec. 30-117. - Service retirement allowance. (a) Upon the retirement, as provided in section 30-116(a) or (b), on or after July 1, 1977, of a member who either has attained his normal retirement date or has attained age 50 and who has completed the number of years of creditable service required for entitlement to benefits under the vesting provisions of section 30-116( c), the member shall receive an annual retirement allowance, payable at least monthly to him during his lifetime, the amount of which shall be two percent of his average final compensation multiplied by the number of years of creditable service. Sec. 30-119. - Ordinary disability retirement allowance. (a) Upon retirement as provided in section 30-118, on or after July 1, 1977, a member shall receive an annual retirement allowance, payable at least monthly to him during.his lifetime and continued disability in an amount equal to two percent of his average final compensation multiplied by the number of years of his "disability credited service" as herein defined. 2. That Section 30-133 of the Code of the City of Portsmouth, Virginia (2006), entitled "Social security benefits," is hereby repealed. 3. That this ordinance shall take effect on July 1, 2013 and shall apply only to benefits payable on or after that date.
