<br />parcels known as 'A', 'B' & 'c' as shown on a plat entitled <br />"Subdivision of Property Belonging to Haysom Street Associates, <br />Located at Portsmouth Boulevard & Haysom Street, Portsmouth, <br />Virginia" prepared by Hoggard-Eure Associates and recorded in <br />the Clerk's Office of the City of Portsmouth, Virginia in Map <br />Book 15, Page 19. <br /> <br />3. That the subject property shall be subject to the following conditions as <br />proffered by the applicant for rezoning: <br /> <br />(a) The property will be rezoned to General Mixed Use GMU. <br /> <br />(b) The undeveloped portion of the site will be developed in <br />accordance with the requirements of the GMU district; provided, <br />however, the following uses will not be permitted: entertainment <br />establishments, any adult use (bookstore, motion picture theater or <br />entertainment establishment), drive-thru restaurant, massage <br />parlor, liquor sales, flea market or fuel oil sales. <br /> <br />(c) The following uses will not be permitted on the property: <br />convention center, psychiatric treatment facility and conference <br />facility. Training facilities will be permitted <br /> <br />(d) The following uses, if desired on the property, will require a <br />conditional use permit: bar or brewpub, gasoline sales, auto parts <br />sales and installations, automobile sales, car wash facilities, <br />motorcycle sales or rentals and tire/muffler sales and installation. <br /> <br />(e) The existing mature vegetation along Portsmouth Boulevard shall <br />be maintained during the development of the BB&T new facility. <br /> <br />4.
