<br />Sec. 15.1-20. Food service manager; required, exemptions. <br /> <br />(a) It shall be unlawful for any person to operate a food establishment unless such <br />person currently employs a food service manager to supervise the establishment's food service <br />employees; the operator shall post in a conspicuous place in the food establishment, in letters not <br />less than one inch in size, the name of each food service manager currently employed. <br /> <br />(b) No owner or operator of a high risk food establishment shall employ one food <br />service manager to supervise the food service employees of two or more food establishments. <br /> <br />(c) Unless deemed warranted after risk assessment and review of the records of <br />establishment's operation by the director, the following food establishments are exempt from the <br />provisions of this section: (i) food establishments that exclusively serve, sell or distribute <br />prepackaged foods which are contained in securely sealed or wrapped bottles, cans, cartons or other <br />similar containers; (ii) temporary food establishments in the discretion of the director following a <br />risk assessment thereof; and (iii) such other food establishments designated by the director in his or <br />her discretion following a risk assessment thereof. <br /> <br />Sec. 15.1-21 -15.1-25. Reserved. <br /> <br />ARTICLE IV. MOBILE FOOD EST ABLISMENTS <br /> <br />Sec. 15.1-26. Permit. <br /> <br />(a) Persons responsible for a mobile food facility are required to obtain a Health <br />Department permit from the Public Health department before beginning operation. <br /> <br />(b) The permit is not transferable to another party. <br /> <br />(c) Issuance of a permit shall not relieve the recipient from any other applicable city or <br />state requirement for operation. <br /> <br />Sec. 15.1-27. Tracking Decals. <br /> <br />(a) Tracking decals will be required by all food vendors using push-carts, and other <br />mobile units (i.e. trailer and/or mobile trucks) within the city limits. <br /> <br />(b) Tracking decals shall be obtained prior to obtaining a business license from the <br />Commissioner of Revenue's office. <br /> <br />(c) Prior to receiving a decal, new vendors shall: <br /> <br />1. Complete a Commonwealth of Virginia Permit Application; and <br /> <br />2. Pay the permit application fee and the plan review fee if applicable. <br />
