<br />(b) It shall be the duty of the director, prior to the issuance of a permit required by this <br />section, to cause an inspection to be made of the premises in which the business is to be conducted <br />and to refuse the permit if the conditions of the premises do not conform to the requirements of this <br />chapter. The director may refuse such permit to an applicant with a past record of unsatisfactory <br />compliance in the operation of a food establishment. If refused, the applicant will be granted a <br />hearing before the director and if the permit is refused following the hearing, the applicant may <br />appeal to the Commissioner of Public Health if applying for a state permit and to the City Council if <br />applying for a city permit. <br /> <br />(c) The commissioner of the revenue shall not issue a license for the conduct of a food <br />establishment without the applicant presenting a certificate of authorization from the director of <br />public health. <br /> <br />Sec. 15.1-15. Conducting food service establishment operation in room used for domestic <br />purpose. <br /> <br />None of the operations connected with a food service establishment shall be conducted in <br />any room used for domestic purposes. <br /> <br />Sec. 15.1-16. Operating Permit--Not transferable. <br /> <br />The permit to operate a food establishment IS not transferable to another person or <br />corporation or from one location to another. <br /> <br />Sec. 15.1-17. Risk assessments. <br /> <br />Each establishment shall have an analysis of its operation and menu conducted by the <br />director to determine the potential for a foodbome illness to occur and, in turn, the frequency of <br />inspection that shall be required. A fee for each risk assessment shall be paid by the applicant to the <br />health department cooperative budget to defray administrative expenses. Only in the event of a <br />change in the establishment's menu and lor operation shall a new risk assessment be required. <br /> <br />Sec. 15.1-18 Periodic inspections and inspection reports. <br /> <br />(a) It shall be the duty of the director to cause inspections to be made of all food <br />establishments in accordance with established frequency based on risk assessment classification. <br />Following proper identification, the operator of a food establishment shall permit access to all parts <br />of the establishment at any time it is open, upon request of the director of public health or his <br />authorized representative. <br /> <br />(b) One copy of the inspection report shall be posted by the owner or operator so that it <br />is readable by the employee(s) of the establishment. <br /> <br />Sec. 15.1-19. Food service card. <br /> <br />(a) It shall be unlawful for any person to work or be employed in any capacity in any <br />food establishment unless such person shall have first completed the requirements for, and obtained, <br />
