<br />(a) The following sections of the FDA Model Food Code, as amended, are modified to <br />read as follows: <br /> <br />(1) Section 1-201.10(35): "Food employee" means an individual working with unpackaged <br />food, food equipment or utensils, food contact surfaces, or packaged potentially hazardous <br />foods. <br /> <br />(2) Section 1-201.10(73): "Regulatory authority" means the local, state, or federal <br />enforcement body or authorized representative having jurisdiction over the food <br />establishment, including the director of public health. <br /> <br />(3) Section 3-302.12. Add to the end of the section the following sentence: Food <br />containers shall be labeled in a language that is understood by the regulatory authority and <br />by the employee. <br /> <br />(4) Section 3-306.14: Add to the end of the subsection the following subsection: <br />(c) There shall be no re-service of food on self-service food bars. <br /> <br />(5) Section 8-304.10(A): (A) At the time the permit is first issued, the regulatory authority <br />shall make the permit holder aware of locations where the permit holder may review this <br />code. <br /> <br />(6) Section 8-811.1O(B) is amended as follows: <br /> <br />A person who violates a provision of this Code shall be guilty of a misdemeanor, <br />punishable by: <br />(1) A fine of not more than $1,000, or by confinement in jail not to exceed six <br />months, or both; or <br /> <br />(2) If the person has been convicted previously of violating this Code or if a <br />court finds that any violation occurred with intent to defraud or mislead, a <br />fine of not more than $2,500 or confinement in jail not to exceed 12 months <br />or both. <br /> <br />Sec. 15.1-7. Future amendments to Chapter. <br /> <br />The director shall recommend amendments to this chapter consistent with the <br />recommendations of the United States Public Health Service/ Food and Drug Administration and <br />the needs of the City of Portsmouth. <br /> <br />Sees. 15.1-8-15.1-10.
