<br />Sec. 15.1-2. Application of chapter generally. <br /> <br />In addition to the places, entities and establishments specifically regulated elsewhere in this <br />chapter, the provisions of this chapter shall be applicable, without limitation, to food-vending <br />machines, trucks, pushcarts and wagons for the sale or display of food products, ice cream products <br />or other ice confectionaries, delivery vehicles used in the delivery of meats and products of bakeries <br />and confectioners and vehicles used in the transportation, sale or delivery of food. Nothing <br />contained in this section shall be construed to limit in any way the application of the provisions and <br />requirements of this chapter to boarding houses, tourist homes, food establishments and itinerant <br />restaurants. <br /> <br />Sec. 15.1-3. Enforcement of chapter. <br /> <br />The Director of Public Health shall be responsible for the enforcement of this chapter. <br /> <br />Sec. 15.1-4. Violation of chapter generally. <br /> <br />Unless otherwise specifically provided, any person who violates any provision of this <br />chapter shall be guilty of a class 1 misdemeanor. <br /> <br />Sec. 15.1-5. Federal Model Food Code adopted and incorporated by reference. <br /> <br />(a) There is hereby adopted by the city for the purpose of establishing rules and <br />regulations Chapters 1 through 8, inclusive, and all appendices and annexes of the United States <br />Food and Drug Administration/Public Health Service 2009 Model Food Code ("FDA Model Food <br />Code"), as adopted and promulgated by the United States Food and Qrug Administration/Public <br />Health Service ("FDA/USPHS"), including such chapters, appendices and annexes, as may hereafter <br />be amended from time to time, but excepting those sections identified in Section 15.1-6 of this <br />chapter. The referenced provisions of the FDA Model Food Code are hereby adopted and <br />incorporated in their entirety into this chapter as if fully set forth herein. In the event of conflict or <br />inconsistency between this chapter and the FDA Model Food Code, the provisions of this chapter <br />shall control. When used in the FDA Model Food Code, the term "health authority" shall mean the <br />director. <br /> <br />(b) The director is hereby authorized to prepare and promulgate regulations consistent <br />with this chapter that are designed to carry out the purposes and provisions and to assist in the <br />administration and enforcement of this chapter. In promulgating regulations, the director shall <br />consider accepted standards of health, hygiene, sanitation, safety and physical plant management. <br />Any regulations prepared by the director shall not become effective until they have been presented <br />to and approved by city council. The director may assess fees as appropriate to cover the <br />administrative costs for implementation of programs. <br /> <br />(c) A certified copy of the FDA Model Food Code shall be maintained by the director at <br />the main administrative office of the health department and shall be available for review by <br />members of the public. <br /> <br />Sec. 15.1-6.
