Sec. 15.1-2. Application of chapter generally. In addition to the places, entities and establishments specifically regulated elsewhere in this chapter, the provisions of this chapter shall be applicable, without limitation, to food-vending machines, trucks, pushcarts and wagons for the sale or display of food products, ice cream products or other ice confectionaries, delivery vehicles used in the delivery of meats and products of bakeries and confectioners and vehicles used in the transportation, sale or delivery of food. Nothing contained in this section shall be construed to limit in any way the application of the provisions and requirements of this chapter to boarding houses, tourist homes, food establishments and itinerant restaurants. Sec. 15.1-3. Enforcement of chapter. The Director of Public Health shall be responsible for the enforcement of this chapter. Sec. 15.1-4. Violation of chapter generally. Unless otherwise specifically provided, any person who violates any provision of this chapter shall be guilty of a class 1 misdemeanor. Sec. 15.1-5. Federal Model Food Code adopted and incorporated by reference. (a) There is hereby adopted by the city for the purpose of establishing rules and regulations Chapters 1 through 8, inclusive, and all appendices and annexes of the United States Food and Drug Administration/Public Health Service 2009 Model Food Code ("FDA Model Food Code"), as adopted and promulgated by the United States Food and Qrug Administration/Public Health Service ("FDA/USPHS"), including such chapters, appendices and annexes, as may hereafter be amended from time to time, but excepting those sections identified in Section 15.1-6 of this chapter. The referenced provisions of the FDA Model Food Code are hereby adopted and incorporated in their entirety into this chapter as if fully set forth herein. In the event of conflict or inconsistency between this chapter and the FDA Model Food Code, the provisions of this chapter shall control. When used in the FDA Model Food Code, the term "health authority" shall mean the director. (b) The director is hereby authorized to prepare and promulgate regulations consistent with this chapter that are designed to carry out the purposes and provisions and to assist in the administration and enforcement of this chapter. In promulgating regulations, the director shall consider accepted standards of health, hygiene, sanitation, safety and physical plant management. Any regulations prepared by the director shall not become effective until they have been presented to and approved by city council. The director may assess fees as appropriate to cover the administrative costs for implementation of programs. (c) A certified copy of the FDA Model Food Code shall be maintained by the director at the main administrative office of the health department and shall be available for review by members of the public.
