<br />The final building elevations shall be approved administratively by the <br />City of Portsmouth Planning Director. It shall be in conformance with the <br />building elevations entitled "CVS #75990 Portsmouth, VA " dated <br />November 17, 2009, prepared by NORR Architects, Engineers, Planners <br />which is on file in the Planning Department. <br /> <br />(c) The existing pylon sign will be removed from the property and a twelve <br />foot (12') tall monument sign will be constructed in lieu of the twenty six <br />foot (26') tall freestanding sign allowed by the zoning ordinance. <br />Additionally, low accent landscape plantings shall be added around the <br />base of the monument sign. <br /> <br />(d) Traffic and roadway improvements within the public right-of-way will be <br />constructed in accordance with the recommendations as set forth by the <br />Traffic Impact Assessment for CVS/pharmacy Store #75990 as prepared <br />by Kimley-Horn & Associates. <br /> <br />(e) Although allowed by right and/or conditional use permit in this zoning, <br />uses which shall never be allowed on this property are as follows: <br /> <br />· Adult Bookstore <br />· Massage Parlor <br />. Adult Motion Picture Theaters <br />. Adult Entertainment Establishment <br />· Halfway House <br />. Adult Retail Sales <br /> <br />(f) Landscaping for the site shall be in substantial conformance with the Site <br />Plan titled "Rezoning Exhibit 2" dated December 16,2009, prepared by <br />Kimley-Horn & Associates. The plan is on file in the Planning <br />Department. <br /> <br />4. That this ordinance shall take effect on the date of its adoption. <br /> <br />ADOPTED by the Council of the City of Portsmouth, Virginia, at a meeting held <br />on February 23,2010. <br /> <br />Teste: <br /> <br />City Clerk <br />
