<br />(2) The Chief of the Portsmouth City Department of Fire, Rescue and <br />Emergency Services and the Commanding Officers of Portsmouth-based <br />Coast Guard cutters, U.S. Coast Guard Sector Hampton Roads, and all shore <br />commands located on U.S. Coast Guard Base Support Unit Portsmouth are <br />authorized and directed to draft and update, as deemed necessary, detailed <br />plans of operation and procedure for the technical implementation of this <br />Agreement. <br /> <br />(3) The senior fire department officer or on-scene fire fighting representative <br />or any party to this Agreement is authorized to directly request fire fighting <br />assistance from the other when deemed necessary. <br /> <br />(4) The senior fire department officer or on-duty representative of either party <br />receiving such a request shall forthwith take the following action: <br />a. Determine what apparatus and personnel are necessary and available <br />for an effective response; <br />b. Brief responding personnel on the mission assigned and dispatch such <br />apparatus as is deemed practicable. <br /> <br />(5) When requested, the City of Portsmouth will send at least one (1) engine, <br />if available, to assist with firefighting and to provide firefighting water for <br />vessel fires onboard U.S. Coast Guard Base Support Unit Portsmouth. <br /> <br />(6) All costs incurred by a party in furnishing fire protection and responding <br />to any actual or potential emergency, for or on behalf of the other party, shall <br />be borne by the party providing the protection or responding to the <br />emergency. The City of Portsmouth and its officers and employees and the <br />United States and its officers and employees shall have all of the immunities <br />from liability and other benefits provided by law while performing under this <br />agreement. <br /> <br />(7) U.S. Coast Guard Sector Hampton Roads will provide vessels, if available, <br />to assist the City of Portsmouth with perimeter control during fires on the <br />waterfront. <br /> <br />(8) The senior on-scene U.S. Coast Guard representative shall maintain <br />operational control of Coast Guard floating resources assigned. <br /> <br />(9) U.S. Coast Guard Base Support Unit Portsmouth will provide suitable <br />berthing for the City of Portsmouth's fireboat. <br /> <br />(10) U.S. Coast Guard Base Support Unit Portsmouth will assume no <br />responsibility or liability for the security of the fireboat or its contents while <br />moored at U.S. Coast Guard Base Support Unit Portsmouth, but shall conduct <br />periodic security checks of it as a courtesy. <br /> <br />2 <br />
