<br />Sec. 40-56.9. Maintenance of properties. <br /> <br />Nothing in this division shall be construed to prevent the normal repair and maintenance <br />of any exterior architectural feature or ordinary yard maintenance in the Downtown Districts to <br />correct deterioration, decay or damage, or to sustain the existing form. Normal repair and <br />maintenance shall not include a material change in design, material, color or outer appearance <br />and does not require a certificate of appropriateness. In addition, this paragraph does not prohibit <br />any repair, maintenance, painting or alteration of any such feature that the building official <br />certifies to be required for public safety because of an unsafe or dangerous condition. <br /> <br />Normal maintenance and repair shall include the following and similar actions which in <br />the sole opinion of the Committee or its designated staff will have no greater effect on the <br />character of the district than those listed: <br /> <br />(1) Repainting in the same color. <br /> <br />(2) Replacement of broken windowpanes, missing roof shingles, or missing features <br />with matching in-kind materials. <br /> <br />(3) Addition or deletion of television or radio antennas, skylights or solar collectors <br />in locations not visible from a public street. <br /> <br />(4) Planting of grass, trees and shrubs, but not including landscape treatment which <br />substantially alters the contour of a site or involves landscaping or construction of parking areas, <br />fences, walls, walkways, pools, fountains and the like which materially affect the appearance of a <br />site and which is visible from a public street. <br /> <br />(5) Any changes to a structure that are not visible from a public street. <br /> <br />Sec. 40-56.10. Downtown Design Committee. <br /> <br />For the general purposes ofthis chapter and specifically to preserve and protect historic <br />places and areas in Portsmouth through the control of demolition and regulation of architectural <br />design and uses of structures in such areas, a Downtown Design Committee is established. <br /> <br />(a) The Downtown Design Committee shall consist of seven members who shall be <br />appointed by the city council and who shall serve without compensation. <br /> <br />(b) All members must have demonstrated an interest or competence in or knowledge <br />of historic preservation and shall include at least: <br /> <br />1. Two members who are registered architects or architectural historians; <br /> <br />11. One registered Landscape Architect; <br /> <br />111. Two residents or business owners; <br /> <br />IV. Two members with professional training or equivalent experience in engineering, <br />planning, real estate or realtors, or a contractor and; <br /> <br />v. Up to three alternates as defined below. <br /> <br />(c) The city council, in additional to the seven voting members, may appoint a non- <br />voting liaison to the Committee from its own body. <br />
