<br />ORDINANCE II. 2 0 O~I~O; <br /> <br />AN ORDINANCE TO AMEND CHAPTER 22 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (2006), BY ADOPTING A NEW SECTION 22-702.1 <br />PERTAINING TO PEDESTRIANS IN CERTAIN STREETS. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. That the Code of the City of Portsmouth, Virginia (2006) be, and hereby is, <br />amended and reordained by enacting and adding thereto a new section, numbered 22-702.1, as <br />follows: <br /> <br />Section 22-702.1. Pedestrians in arterial and collector streets, and in ramps to Interstate <br />highways. <br /> <br />(a) For the purpose of this section, "street" shall mean any arterial or collector street, <br />including the median thereof, and also the entrance or exit ramp to any Interstate <br />highway, provided the street is open to traffic at the time in question. It shall not include, <br />and this section shall not apply to, any local street. <br />(b) It shall be unlawful for any pedestrian to remain in a street for any longer than is <br />reasonably necessary for the purpose of safely traversing the street. <br />(c) This section does not apply to: <br />(1) a pedestrian walking along the outer edge of a street when an obstacle or the <br />absence of a sidewalk reasonably causes the person to walk there. <br />(2) a pedestrian who is in the immediate process of crossing a street. <br />(3) a pedestrian whose presence in a street is caused by an accident, a vehicular <br />breakdown, an emergency, a medical condition, or a physical infirmity. <br />(4) any government employee, agent, or contractor engaged in the conduct of <br />official business or performing work for that governmental unit. <br />(5) any utility employee, agent, or contractor engaged in official business of the <br />utility. <br />(6) any person engaged in emergency response or providing assistance that has <br />been requested by a motorist. <br />(d) A first violation of this section shall constitute a Class III misdemeanor. A second and <br />any subsequent conviction shall constitute a Class II misdemeanor. <br /> <br />2. That this ordinance shall take effect on the date of its adoption. <br /> <br />ADOPTED by the Council of the City of Portsmouth, Virginia, at a meeting held on <br />November 10, 2009. <br /> <br />Teste: <br /> <br />City Clerk <br />
