ORDINANCE .~ AN ORDINANCE ACCEPTING $487,093 IN FEDERAL AND STATE FUNDS FROM THE VIRGINIA DEPARTMENT OF TRANSPORTATION (VDOT); REQUESTING THAT VDOT PROGRAM A HIGHWAY SAFETY IMPROVEMENT PROGRAM (HSIP) PROACTIVE SAFETY PROJECT; AND APPROPRIATING $487,093 IN THE FY 2009-2010 CAPITAL IMPROVEMENTS FUND FOR SAID PROJECT. BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That it accepts the sum of$487,093 in federal and state funds from the Virginia Department of Transportation (VDOT) and appropriates said funds in the FY 2009- 2010 Capital Improvements Fund. 2. That, in accordance with VDOT construction allocation procedures, the City of Portsmouth requests that VDOT establish a Highway Safety Improvement Program (HSIP) Proactive Safety Program project. (Project # 000-124-149, P101, UPC 86612) in the City of Portsmouth. 3. That no City matching funds are required for this project. 4. That the Council of the City of Portsmouth hereby agrees to pay its share of the total cost for preliminary engineering, right of way acquisition, and construction, as applicable, of this project in accordance with Section 33.1-44 of the Code of Virginia, and that, if the City of Portsmouth subsequently elects to cancel this project, the City of Portsmouth hereby agrees to reimburse the Virginia Department of Transportation for the total amount of the costs expended by the Department through the date the Department is notified of such cancellation. 5. That the funds appropriated above in the FY 2009-2010 Capital Improvements Program Fund are appropriated for said HSIP Proactive Safety Program project. 6. That estimated revenues in the FY 2009-2010 Capital Improvements Program Fund are increased by $487,093. 7. That this ordinance shall take effect on the date of its adoption.
