<br />URJltAIIE It ~.~.?~~8 ~ <br /> <br />AN ORDINANCE TO AMEND CHAPTER 2 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (2006) BY AMENDING SECTIONS 2-101 AND 2-107 <br />THEREOF PERTAINING TO COUNCIL APPOINTEES AND A RESIDENCY <br />REQUIREMENT. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br />1, That sections 2-101 and 2-107 of the Code of the City of Portsmouth, <br />Virginia (2006) be, and hereby are, amended and reordained to read as follows: <br /> <br />Sec. 2-101. Appointment. <br /> <br />The City Council shall appoint the City Manager, City Attorney, City Assessor, <br />and City Clerk. All other officers and employees shall be appointed by the City Manager, <br />except when otherwise specifically provided, <br /> <br />Sec. 2-107. Residence requirements. <br /> <br />(a) All officers who are appointed by the City Council shall be bona fide <br />residents of the city or become such within six months after the effective date of their <br />appointment unless such time period is extended by the City Council. Upon failure to <br />comply with this subsection, their employment shall immediately cease, <br /> <br />(b) For all city employees other than those covered by subsection (a) of this <br />section, there shall be no residence requirement, except that the City Manager may, in his <br />discretion, require that any department head subject to his appointive power remain a <br />resident of the city or become such within six months after the effective date of his <br />appointment. <br /> <br />2, That this ordinance shall take effect on the date of its adoption, <br /> <br />ADOPTED by the Council of the City of Portsmouth, Virginia, at a meeting held <br />on May 26, 2009, <br /> <br />Teste: <br /> <br />City Clerk <br />
