<br /> <br />family and duplex development, one of two side yards required for single-family <br />dwellings other than townhouses may be waived, provided, that: <br /> <br />(I) Each lot provides the minimum lot area for a single family residence for that <br />historic district; <br /> <br />(2) No more than two dwelling units are joined together; <br /> <br />(3) An existing subdivision plat is being used and no replatting of a lot or lots is <br />required; <br /> <br />(4) The remaining unattached side yard is not less in width than three feet; <br /> <br />(5) Any wall facing on the zero side lot line is a structural wall capable of providing <br />protection from fire, noise and visual encroachment; <br /> <br />(6) A one-foot eave encroachment is permitted across the line into the adjoining lot; <br /> <br />(7) A housing use permit is approved by the City Council. <br /> <br />(8) Zero lot development shall be utilized for new construction only. <br /> <br />ADOPTED by the Council of the City of Portsmouth, Virginia at a meeting held <br />on November 27, 2007. <br /> <br />Teste: <br /> <br />City Clerk <br />
