<br />ORDtNANCE NO.:..o_~:2.~? <br /> <br />AN ORDINANCE TO AMEND CHAPTER 40 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (2006) BY AMENDING TABLE 40-53.3 AND <br />SECTIONS 40-53.3, 40-53.4(1), AND 40-162.1 THEREOF AND BY ADOPTING A <br />NEW SECTION 40-53.8 THERETO PERTAINING TO SINGLE-FAMILY LOT <br />AREAS, PARKING REQUIREMENTS, LOT MERGERS, AND ZERO LOT <br />LINES IN HISTORIC DISTRICTS. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. That Table 40-53.3 of Section 40-53.3 of the Code of the City of <br />Portsmouth, Virginia (2006) be amended to establish a minimum lot size of2500 square <br />feet for a single-family residential lot. <br /> <br />2. That Sections 40-53.4(f) and 40-162.1 of the Code of the City of <br />Portsmouth, Virginia (2006) be amended and reordained to read as follows: <br /> <br />Sec. 40-53.4. Historic districts; parking, loading and signs. <br /> <br />The following off-street parking requirements shall apply in all historic districts: <br /> <br />(f) The planning commission may, upon application, reduce, or eliminate the <br />off-street parking requirements in the historic limited office and historic limited business <br />subdistricts of all districts. <br /> <br />Sec. 40-162.1. Lot merger. <br /> <br />In order to minimize the number of nonconforming zone lots, if two or more <br />adjoining lots or parcels with continuous frontage on a public street are in a single <br />ownership and if either or any of such lots or parcels individually are too small in any <br />dimension to meet the yard, width and lot area requirements of the district in which they <br />are located, then such group of lots or parcels shall be considered as a single zone lot or <br />several zone lots of such size as is necessary to meet the minimum dimensional <br />requirements of the district. The provisions of this section shall not apply to lots or <br />parcels within a historic district. <br /> <br />3. That a new Section 40-53.8, entitled "Historic districts; zero lot line <br />development," be adopted and added to the Code of the City of Portsmouth, Virginia <br />(2006) to read as follows: <br /> <br />Sec. 40-53.8. Historic districts; zero lot line development. <br /> <br />Regardless of the requirements of Section 40-53.3 and Table 40-53.3 and <br />the notes contained in the table, in all historic zoning districts that allow single <br />
