<br /> <br />ORDINANCE NO._~~~~ <br /> <br />AN ORDINANCE TO AMEND CHAPTER 40 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (2006) BY AMENDING SECTION 40-162 <br />THEREOF TO GRANT AUTHORITY TO THE ZONING ADMINISTRATOR TO <br />WAIVE CERTAIN ZONING DIMENSIONAL REQUIREMENTS. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. That Section 40-162 of the Code of the City of Portsmouth, Virginia <br />(2006) be amended and reordained to read as follows: <br /> <br />Sec. 40-162. Waivers allowed; nonconforming zone lots. <br /> <br />The zoning administrator may issue a zoning clearance for the purposes of the <br />building permit process for a single family detached structure on any lot of record <br />lawfully existing on April 25, 1961 or on the date of any applicable amendment to the <br />ordinance which meets at least 80% of each dimensional requirement required for the <br />zoning district in which the lot is located. Any structure receiving such a zoning <br />clearance shall be constructed so as to conform generally to the design and appearance of <br />neighboring properties. <br /> <br />2. That this ordinance shall take effect on the date of its adoption. <br /> <br />ADOPTED by the Council of the City of Portsmouth, Virginia at a meeting held <br />on November 27, 2007. <br /> <br />Teste: <br /> <br />City Clerk <br />
