<br />~ <br />'J <br />~f 1 <br />1 <br />i <br />I <br />I <br /> <br />ORDINAII[ .._~OON5J' <br /> <br />AN ORDINANCE TO AMEND CHAPTERS 35 AND 40 AND APPENDIX A OF <br />THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (2006) BY <br />AMENDING SECTIONS 35-190, 40-22, 40-61.1, 40-71.1 (a), 40-196, AND <br />APPENDIX A AND BY REPEALING SECTIONS 40-51 THROUGH 40-54, 40- <br />171.2, AND 40-178 THEREOF PERTAINING TO THE CITY'S HISTORIC <br />DISTRICTS. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. That Section 35-190 of Chapter 35 of the Code of the City of Portsmouth, <br />Virginia (2006) be amended and reordained to read as follows: <br /> <br />Sec. 35-190. Does not apply when historic structure demolished. <br /> <br />Where rehabilitation is achieved through demolition or replacement of an existing <br />structure, the exemption provided for in this division shall not apply when any structure <br />demolished is a local, state, and/or federally designated_historic structure as defined in <br />Section 40-51. <br /> <br />2. That Section 40-22 of the Code of the City of Portsmouth, Virginia (2006) <br />be amended by the addition of the following definitions: <br /> <br />Sec. 40-22. Definitions. <br /> <br />Alteration. Any change, modification, or addition to the exterior of any building <br />or structure or any part thereof. <br /> <br />Building Official. The person appointed by the city manager as the individual who <br />issues the permit for the construction, alteration, reconstruction, or demolition of <br />buildings and other structures. <br /> <br />Building permit. A permit issued by the building official authorizing the <br />construction, alteration, reconstruction, or demolition of a building or other structure. <br /> <br />Contributing properties. Those properties that by reason of form, materials, <br />architectural details and relation to surrounding properties contribute favorably to the <br />general character of the historic district in which they are located. <br /> <br />Certificate of appropriateness The approval statement signed by the secretary of <br />the historic preservation commission certifying the appropriateness of a proposal for <br />construction, alteration, reconstruction, repair, restoration, or demolition affecting the <br />exterior of a building, structure, or other property within an historic district or of an <br />historic property within the city.. <br /> <br />Demolition The dismantling or tearing down of all or part of any building and <br />
