R-06-19 A RESOLUTION GRANTING APPROVAL OF A GROUP HOUSING USE PERMIT (GHP-06-04) TO THE LAWSON COMPANIES TO CONSTRUCT 120 RESIDENTIAL APARTMENT UNITS ON THE SITE OF THE CURRENT PORTSMOUTH ESTATES IN THE HODGES MANOR NEIGHBORHOOD. WHEREAS, The Lawson Companies has made application, pursuant to Section 40-112 of the Code of the City of Portsmouth, Virginia (1988), as amended, for the approval and granting of a group housing use permit for 120 residential apartment units on the site of the current Portsmouth Estates in the Hodges Manor neighborhood, Portsmouth, Virginia; and WHEREAS, the subject property is furthermore described as: GHP-06-04 All those 30 lots, with the buildings and improvements thereon and the appurtenances thereunto belonging, situate in the City of Portsmouth, Virginia, and being known, numbered and designated as Lots 6 through 20 and 45 through 61, as shown on that certain plat entitled "MAP OF PORTSMOUTH ESTATES PROPERTY OF PAT REALTY CORP" NORFOLK COUNTY, V A, SCALE I "=50''', dated March 30, 1943, prepared by Jno, M, Baldwin, Civil Engineer, Norfolk, Virginia and recorded in the Clerk's Office of the Circuit Court of the City of Chesapeake, Virginia, (formerly Norfolk County, Virginia), in Map Book 27, at page 10, and WHEREAS, the Planning Commission has reviewed such application and site plan submitted therewith and has recommended conditional approval of said application; and WHEREAS, the applicant has been informed that approval of the group housing project pursuant to Section 40-116 only grants an exemption from certain requirements for residences as stated in said section and does not constitute a waiver of any other requirement embodied in the Subdivision Ordinance, Zoning Ordinance, Code of the City of Portsmouth, Virginia, or any other applicable local, state or federal law or regulation; and
