<br />Sec. 40-44.3. Effect of housing review. <br /> <br />Through the housing review process, and subject to the applicable requirements <br />and standards, the city council may allow deviations from the minimum lot size and <br />dimensions and the minimum yard setbacks in any residential district but may not allow <br />deviations along project boundaries or from the maximum density, minimum floor area <br />or maximum site coverage requirements. <br /> <br />Sec. 40-49. Traditional neighborhood development. <br /> <br />(g) Expiration of multi-family approval. Multi-family residential development <br />identified in the TND application process and approved through the housing use permit <br />process must be constructed within ten years of approval of the housing use permit by the <br />city council. However, the developer may petition the planning commission for a five- <br />year extension of the expiration deadline. Such petition shall be filed no later than 90 <br />days after expiration of the original housing use permit. The planning commission shall <br />grant such extension if it finds that the developer has moved with dispatch to execute the <br />approved project. <br /> <br />Sec. 40-52.1. Historic district; uses. <br /> <br />(c) Historic limited business. All uses permitted in the neighborhood <br />commercial C-l district shall be permitted. Multifamily dwellings and housing for the <br />elderly shall be permitted upon approval of a housing use permit by city council. <br />Residential dwelling units may be incorporated in structures where the principal use is <br />commercial or semicommercial under the terms of neighborhood commercial C-!; <br />provided, that a dwelling unit containing one (I) bedroom shall incorporate no less than <br />four hundred (400) square feet of usable floor area therein, a dwelling unit with two (2) <br />bedrooms no less than seven hundred (700) square feet and a dwelling unit with three (3) <br />bedrooms no less than eight hundred (800) square feet. <br /> <br />Scc. 40-102. Exception for excavation use permits and housing use permits. <br /> <br />Because of the unique nature of excavation use permits, the procedure for <br />reviewing application for such permits shall be the procedure in article X and not the <br />procedure in this article. Because of the unique nature of housing use permits, the <br />procedure for reviewing application for such permits shall be the procedure in article IX <br />and not the procedure in this article. <br />
