'I _"', AN ORDINANCE TO AMEND CHAPTERS 11 AND 40 AND APPENDIX A OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (2006) BY AMENDING SECTIONS 11-10, 40-22, 40-43.1, 40-43.4, 40-44.3, 40-49(g), 40- 52.I(c), 40-102, 40-106.1, 40-111, 40-112, 40-112.5, 40-114 THROllGH 40-120, TABLES 40-43.1-1, 40-43.1-2, 40-43.1-3, AND 40-44-1, PERTAINING TO HOUSING USE PERMITS, AND SECTION 40-163 PERTAINING TO NON- CONFORMING USES. BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: I. That Section 40-22 of the Code of the City of Portsmouth, Virginia (2006) be amended by amending the definition of "Group housing project" and reordained to read as follows: Housing project. A housing project is any project consisting of more than one residential unit on one or more sites, where either the building arrangement as proposed is such that the property cannot be subdivided into conventional streets and lots that meet the requirements of this chapter and chapter 33 of the City Code or the building arrangement as proposed is such that the buildings and/or lots will not conform to all of the applicable requirements of this chapter. 2. That Sections 40-43.1,40-44.3, 40-49(g), 40-52.1 (c), 40-102,40-106.1, 40-111,40-112,40-112.5,40-114 through 40-120 of the Code of the City of Portsmouth, Virginia (2006) be amended and reordained to read as follows: Sec. 40-43.1. Use schedules adopted. The use schedules, included with the original copy of the ordinance from which this chapter derived, are hereby adopted. Uses designated "Permitted Use in District" in any district shall be permitted in such district, subject to such conditions as may be indicated in the "Condition" column and subject to the other requirements of this chapter. Uses designated to require a use permit in any district shall be permitted in such district only upon the issuance of a use permit in accordance with the procedures and standards of this chapter, and subject to such conditions as may be indicated in the "Condition" column and subject to the other requirements of this chapter. Uses designated to require a housing use permit in any district shall be permitted in such district only upon approval of a housing use permit by city council. Uses not designated as a permitted use in district or as requiring a use permit or housing use pcrmit in a district are not permittcd in such district unless otherwise expressly permitted under this chapter, in accordance with Section 40-43.
