<br />Sec. 40-106.1. Expiration of use permits. <br /> <br />Except as provided for housing use permits in section 40-115, if a building <br />permit, certificate of occupancy, commercial reinspection, business license, or any other <br />required authorization or permit for the allowed use is not issued and if the use has not <br />commenced within two years of the effective date of final city council approval of the <br />use, the use permit shall automatically expire. Prior to, and within three months of the <br />expiration of the permit, if the applicant gives satisfactory evidence that progress is being <br />made toward commencement of the approved use, the planning commission may grant a <br />one-year extension of the expiration date of the use permit. <br /> <br />ARTICLE IX. HOUSING USE PERMIT <br /> <br />Sec. 40-111. Housing use permit. <br /> <br />A housing project designated by a "*,, in the use tables, shall be permitted only <br />with a housing use permit. A housing use permit may be issued through the process set <br />forth in this article only if the proposed project meets the standards of this article. <br /> <br />Sec. 40-112. Housing use permit applications. <br /> <br />An application for a housing use permit shall be submitted on such forms and <br />with such information as is required by this article and shall be accompanied by such fee <br />as is specified in article XII. <br /> <br />Sec. 40-112.5. Preliminary plat or equivalent. <br /> <br />If the proposed housing project will be subdivided in accordance with chapter 33, <br />the preliminary plat required by section 33-73 shall be submitted simultaneously with the <br />housing project use permit application. <br /> <br />Sec. 40-114. Effect. <br /> <br />After city council approval of a proposed housing project, no other permit shall be <br />issued nor shall any plat be approved or recorded except in conformity with the approved <br />projcct plans. <br /> <br />Sec. 40-115. Expiration of housing use permits. <br /> <br />If a developer has not submitted an approved site plan for a housing project within <br />two years of city council approval or within six months of the applicable dates reflected <br />in any phasing schedule approved by the city council as part of the project approvaL such <br />approval shall be deemed expired.
