<br />URUlHANCE Mf);2006-63 <br /> <br />AN ORDINANCE TO AMEND CHAPTER 30 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTION 30-236(b) THEREOF <br />ESTABLISHING A MANDATORY RETIREMENT AGE FOR MEMBERS OF THE <br />PORTSMOUTH FIRE AND POLICE RETIREMENT SYSTEM. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br />I. That Section 30-236(b) of the Code of the City of Portsmouth, Virginia (1988) be, <br />and hereby is, amended and reordained to read as follows: <br /> <br />Sec. 30-236. Service retirement. <br /> <br />(b) The provisions of paragraph (a) of this section to the contrary notwithstanding, <br />any member remaining in service after his normal retirement date who attains seventy years of <br />age shall be retired forthwith by the Portsmouth Retirement Board. The Secretary to the Board <br />shall, at least six months prior to the date of any member's seventieth birthday, provide notice to <br />the Board and to the member of this mandatory retirement requirement. Retirement or other <br />appropriate employment action may be mandated for any member, regardless of age, who does <br />not pass applicable physical fitness requirements. <br /> <br />2. That this ordinance shall take effect on the date of its adoption. <br /> <br />ADOPTED by the Council of the City of Portsmouth, Virginia, at a meeting held on July <br />25, 2006. <br /> <br />Teste: <br /> <br />City Clerk <br />
