The owner shall be provided with a written notice listing all violations and the <br />period oftime required to bring the property into compliance. <br /> <br />(b) Upon being brought into compliance, a residential rental dwelling unit <br />shall be subject to periodic inspections until such time as a periodic inspection reveals no <br />violations of the Building Code. <br /> <br />(c) Upon the sale of a residential rental dwelling unit, the Department may <br />perform a periodic inspection subsequent to such sale. <br /> <br />(d) If a residential rental dwelling unit has been issued a certificate of <br />occupancy prior to July 1, 2005, the Department shall grant an exemption for a minimum <br />period of four years from the date of the issuance of the certificate of occupancy. <br /> <br />Sec. 17-90. Revocation of rental inspection exemption. <br /> <br />(a) If the condition of the residential rental dwelling unit violates the Building <br />Code during the exemption period, the Department may revoke the exemption previously <br />granted under this section. <br /> <br />(b) No exemption granted by this section shall be considered permanent. <br />After the expiration of the exemption period, the owner shall submit a written request to <br />the Department for a periodic inspection and shall schedule such inspection within 45 <br />days of the exemption's expiration. <br /> <br />Sec. 17-91. Inspection of a residential rental dwelling unit outside of a designated <br />rental inspection district. <br /> <br />The inspection of a residential rental dwelling unit outside of a designated rental <br />inspection district shall be based upon a determination by the Department that: <br /> <br />i. there is a need to protect the public health, welfare and safety of the <br />occupants of that individual dwelling; and <br />ii. the individual dwelling unit is either blighted, in the process of deteriorating <br />or there is evidence of violations of the Building Code that affect the safe, decent and <br />sanitary living conditions for tenants living in the dwelling unit. <br /> <br />Sec. 17-92. Fees. <br /> <br />Fees for all rental inspections shall be as set forth in section 11.1-4. <br />
