<br />'. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />Sec. 17-86. Provisions for initial and periodic inspections of multi-family dwelling <br />units. <br /> <br />If a multi-family rental dwelling unit has more than ten rental dwelling units, in <br />the initial and periodic inspections, the Department shall inspect only a sampling of the <br />dwelling units, of not less than two and not more than 10% of the dwelling units, of a <br />multi-family development. However, in no event, shall the Department charge a fee <br />authorized by this section for the inspection of more than ten dwelling units. If the <br />Department determines upon inspection of the sampling of dwelling units that there are <br />violations of the Building Code that affect the safe, decent and sanitary living conditions <br />, <br />for the tenants of such multi-family development, the Department may inspect as many <br />dwelling units as necessary to enforce the Building Code. In the latter case, the fee shall <br />be based upon a charge per dwelling unit inspected, as other wise provided in section <br />11.1-4. <br /> <br />Sec. 17-87. Follow-Up Inspections. <br /> <br />Upon the initial or periodic inspection of a residential rental dwelling unit subject <br />to this division, the Department may require the owner of the dwelling unit to submit to <br />such follow-up inspections of the dwelling unit as the Department deems necessary, until <br />such time as the dwelling unit is brought into compliance with the provisions of the <br />Building Code that affect the safe, decent and sanitary living conditions for the tenants. <br /> <br />Sec. 17-88. Periodic Inspections. <br /> <br />Except as provided above in section 17-87, following the initial inspection of a <br />residential rental dwelling unit subject to this ordinance, the Department may inspect any <br />residential rental dwelling unit in a rental inspection district that is not otherwise <br />exempted no more than once each calendar year. The term "periodic inspection" shall <br />not be deemed to include a follow-up inspection as provided in section 17-87. <br /> <br />Sec. 17-89. Exemptions from rental inspection ordinance. <br /> <br />(a) Upon the initial or periodic inspection of a residential rental dwelling unit <br />as described in sections 17-85 and 17-88, and provided that there are no violations of the <br />Building Code that affect the safe, decent and sanitary living conditions for the tenants of <br />such residential rental dwelling unit, the Department shall provide to the owner of such <br />residential rental dwelling unit, an exemption from the rental inspection ordinance for a <br />period of four (4) years. In the event that a violation of the Building Code affecting the <br />safe, decent and sanitary living conditions is found to exist, an exemption will not be <br />
