<br />U\\U\_llOfOO~-10~ <br /> <br />. <br /> <br />AN ORDINANCE TO AMEND CHAPTERS 24 AND 25 OF THE CODE OF THE <br />CITY OF PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTIONS 22-1, <br />22-2(a), 22-10, 22-175, 22-214, 22-391, 22-688, 22-708, AND 25-120 THEREOF AND <br />BY ADOPTING NEW SECTIONS 22-18.1, 22-121.1, 22-175.1, 22-291.1, 22-328.1, 2- <br />400.1, 22-440.1, 22-708.1, AND 22-708.2 THERETO PERTAINING TO MOPEDS <br />AND MOTORIZED PUSH SCOOTERS. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. Sections 22-1, 22-2(a), 22-10, 22-175, 22-214, 22-391, 22-688, 22-708, <br />and 25-120 of the Code of the City of Portsmouth, Virginia (1988) be amended and <br />reordained to read as follows: <br /> <br />Sec. 22-1. Definitions. <br /> <br />The words and phrases used in this chapter shall, for the purposes of this chapter, <br />have the meanings respectively ascribed to them in ~ 46.2-100 of the Code of Virginia as <br />in effect on July 1, 1994, and any subsequent amendments thereto, except in those <br />instances where the context clearly indicates a different meaning. <br /> <br />. <br /> <br />For purposes of this chapter, a motorized push scooter is defined as a conveyance <br />with a flat platform upon which the rider stands, with a post or handlebars or other <br />steering mechanism at the front of the conveyance, with two inline wheels, or three or <br />four wheels and is powered by either an electric or internal combustion motor. Such <br />conveyances may have an optional seat that can be attached for operation in a sitting <br />position. A motorized push scooter shall not include any wheelchair or wheelchair <br />conveyance used to provide mobility for persons who, by reason of physical disability, <br />are otherwise unable to move about as pedestrians. <br /> <br />Sec. 22-2. General penalty for violations of chapter. <br /> <br />(a) Unless otherwise provided, a violation of any of the provisions of this <br />chapter shall constitute a traffic infraction punishable by a fine of not more than $250. <br /> <br />Sec. 22-10. Applicability of chapter to persons operating bicycles, mopeds, <br />motorized push scooters, or driving or riding animals. <br /> <br />Every person operating a bicycle, moped, or motorized push scooter or riding or <br />driving any animal upon a roadway shall be subject to the provisions of this chapter and <br />shall have all of the rights and all of the duties applicable to the driver of a vehicle, unless <br />the context of the provision clearly indicates otherwise. <br />The provisions of subsections A and C of ~ 46.2-920 of the Code of Virginia, <br />applicable to the operation of emergency vehicles under emergency conditions shall also <br /> <br />. <br /> <br />
