<br />rf!~mNAtU .~ <br /> <br />. <br /> <br />AN ORDINANCE TO REPEAL SECTION 24-3 AND ADOPT NEW SECTIONS 3-300 <br />THROUGH 3-305 OF THE CODE OF THE CITY OF PORTSMOUTH, RELATED TO <br />TATTOOING AND BODY ART. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br />I. That Section 24-3 of the Code of the City of Portsmouth, Virginia (1988)) is <br />REPEALED. <br /> <br />2. That a new Article VI in Chapter 3, consisting of new sections 3-300 through 3-305, is <br />ADOPTED to read as follows. <br /> <br />CHAPTER 3: AMUSEMENTS <br /> <br />Article VI: Body Art <br /> <br />Sec. 3-300. Definitions. <br />For the purposes of this chapter, the following words and phrases shall be construed as follows: <br /> <br />Body art: body piercing and/or tattooing. <br /> <br />Body artist: person who practices body art. <br /> <br />. Body art studio: a place in which a person offers, works, or practices as a body artist. <br /> <br />Body art studio operator: a person who controls, operates, conducts, or manages a body art <br />studio. <br /> <br />Body art studio owner: a person who serves as the body art studio's proprietor and ensures the <br />continuous presence of someone who is responsible for monitoring and managing all <br />establishment operations and who is authorized to take actions to ensure compliance with the <br />regulations. <br /> <br />Body piercing: the act of penetrating a person's skin to make a hole into or through which an <br />item of jewelry or some other decorative article may be inserted and/or mounted so as to be <br />visible above the skin. Body piercing does not include the use of a mechanized, pre-sterilized <br />ear-piercing system that penetrates the outer perimeter or lobe of a person's ear or both, nor does <br />it include any medical procedure engaged in by a Virginia-licensed physician or a health care <br />professional under the direct supervision of a Virginia-licensed physician or by a registered nurse <br />or other medical services personnel licensed pursuant to Title 54.! of the Code of Virginia in the <br />performance of their duties. <br /> <br />Body piercer: a person who performs body piercing for compensation. <br /> <br />. <br /> <br />Body piercing studio: a place in which a person offers, works, or practices as a body piercer. <br />
