<br />. <br /> <br />. <br /> <br />. <br /> <br />Hazardous waste: waste or material that may present a threat of infection to humans, including <br />without limitation (a) blood, blood products, body fluids, body parts; and (b) absorbent materials <br />or devices or equipment contaminated with any item listed in subsection (a). <br /> <br />Health Department: the Portsmouth Health District <br /> <br />Health Director: the Director of the Portsmouth Health District. <br /> <br />Permit holder: collectively, any person holding a permit under this chapter, whether as a body art <br />operator or as a body artist. <br /> <br />Sexually private area: for a male, the genitals, pubic area, or buttocks; for a female, the genitals, <br />pubic area, buttocks, or the breast below the aureole. <br /> <br />Tattooing: the process of placing any design, letter, scroll, figure, symbol or any other mark upon <br />or under the skin of any person with ink or any other substance resulting in the permanent <br />coloration of a person's skin, including permanent make-up or permanent jewelry, by the use of <br />a needle or needles, or any other instrument designed to touch or puncture the skin and inject or <br />leave colored dye in the skin. "Tattoo" shall also mean the mark, design, or coloration itself <br />which is thus created. The term shall not include any medical procedure engaged in by a <br />Virginia-licensed physician or a health care professional under the direct supervision of a <br />Virginia- licensed physician or by a registered nurse or other medical services personnel licensed <br />pursuant to Title 54.1 of the Code of Virginia in the performance of their duties. <br /> <br />Tattoo artist: a person who performs the work of tattooing. <br /> <br />Tattoo studio: a place in which a person offers, works or practices as a tattoo artist. <br /> <br />Sec. 3-301. Permit requirements. <br />A. No person shall operate a body art studio without a valid permit from the Health <br />Department. <br /> <br />B. No person shall be a body artist or a body art studio owner or operator without first <br />obtaining an applicable permit from the Health Department. <br /> <br />C. No permit shall be issued unless the applicant has complied with all applicable health <br />requirements of this Chapter and all applicable requirements of the Virginia Board for Barbers <br />and Cosmetology and any other state agency of competent jurisdiction. Permits from the Health <br />Department shall be valid for a period of 1 year from the date of issue and displayed in an area <br />easily viewed by the public. <br /> <br />D. The annual body art studio permit or renewal application for each permit holder shall <br />include the following information: business name and address, permit number, owner name, <br />home address, and phone number, proof of state licensure, and a list and assigned location of all <br />body artists working in the body art studio.
