<br />. <br /> <br />. <br /> <br />. <br /> <br />30 of the year for which such license fee was paid and one-fourth (1/4) of such amount if <br />between July 1 and September 30 of such license year. No refund shall be made after <br />September 30 of such year. <br /> <br />(c) Upon satisfaction that a person is entitled to receive a refund, the <br />commissioner of the revenue shall certify the correct refund amount to the city treasurer <br />who shall mail such amount to the person entitled to the refund. <br /> <br />Sec. 22-92. License fees for vehicles owned by nonresident military personnel. <br /> <br />(a) The commissioner of the revenue is authorized to remove, without <br />payment any license fee imposed by this article, on any person who is on active military <br />duty and is in this city solely by reason of military orders and whose legal residence or <br />domicile is a state other than Virginia, for each motor vehicle, trailer or semitrailer of <br />which he is the sole owner and which is normally garaged, stored or parked within the <br />city limits, provided such motor vehicle, trailer or semitrailer is registered and titled in <br />the commonwealth solely in such person's name or a Virginia license has been purchased <br />for such vehicle. In the event it cannot be determined where such vehicle is normally <br />garaged, stored or parked, situs, for the purpose of this section, shall be the City of <br />Portsmouth when the vehicle is registered with the state department of motor vehicles, <br />utilizing a mailing address in the city. <br /> <br />(b) The burden of proof shall rest with the owner of the motor vehicle, trailer <br />or semitrailer to present sufficient evidence in the form of a current leave and earnings <br />statement to the commissioner of the revenue indicating that the sole owner of the vehicle <br />is on active military duty, is in the city solely by reason of military orders and his legal <br />residence or domicile is a state other than Virginia. If such person fails to do so, he shall <br />be subject to the license fees imposed by this article. <br /> <br />(c) The payment of a license fee as provided in this section is essential to the <br />functioning of the vehicle licensing laws of the city. <br /> <br />Sec. 22-93. License fee for vehicle owned by disabled veteran. <br /> <br />No license fee shall be charged for one (I) motor vehicle owned and used <br />personally by any veteran who holds a current state motor vehicle registration card <br />establishing that he has received a disabled veteran's exemption from the department of <br />motor vehicles and has been issued a disabled veteran's motor vehicle license plate as <br />prescribed in Section 46.2-739 of the Code of Virginia. <br /> <br />Sec.22-129. Obstructions to windshield or windows generally. <br /> <br />(a) Except as otherwise provided in this section or as permitted by state or <br />federal law, rule or regulation, it shall be unlawful for any person to operate any motor <br />
