. 4. THIRD PARTY RENTAL INCOME $2,000.00 flat payment to Owner for each Pavilion Event rented to a third party, to be paid monthly on or before the 20th day of the following month. 5. SPONSORSHIPS a. Naming Rights 1. 25% of the gross revenue shall be paid to the Owner, subject to subparts 2 and 3 below. 2. Notwithstanding subpart 1 above, during the first Operating Year, the first $125,000.00 of revenue shall be paid to Manager, the next . $31,250.00 shall be paid to Owner, and any additional revenues thereafter shall be divided 75% to Manager and 25% to Owner. 3. The Owner's share of the naming rights revenue shall be paid to Owner upon receipt by Manager; provided, however, that if the sponsor requires that all or a portion of the naming rights fee be refunded to the sponsor (or that the sponsor be entitled to a credit) for any reason, including without limitation failure to meet targets or goals, such refund or credit shall be borne pro rata by Manager and Owner in proportion to the amounts to which Manager and Owner are entitled pursuant to subparts 1 and 2 above. Owner shall pay its share of the refund or credit in cash to Manager or, at Manager's option, by credit against any future amounts due to Owner from Manager. . b.
