R-04-51 <br /> <br />A RESOLUTION REQUESTING THE COMMONWEALTH TRANSPORTATION <br />BOARD TO ESTABLISH A CONSTRUCTION PROJECT FOR IMPROVEMENTS AT <br />HOFFLER'S CREEK WILDLIFE PRESERVE IN THE CITY OF PORTSMOUTH. <br /> <br /> WHEREAS, in accordance with Commonwealth Transportation Board construction <br />allocation procedures, it is necessary that a request by Council resolution be made in order that the <br />Virginia Department of Transportation program a transportation enhancement project in the City <br />of Portsmouth. <br /> <br /> NOW THEREFORE BE IT RESOLVED by the Council of the City of Portsmouth, <br />Virginia, that it hereby requests the Commonwealth Transportation Board to establish a project for <br />improvements at Hoffier's Creek Wildlife Preserve in the City of Portsmouth. <br /> <br /> BE IT FURTHER RESOLVED that the Council of the City of Portsmouth hereby agrees <br />to pay 20% of the eligible costs for planning, design, and construction of this project in <br />accordance with Section 33.1-44 of the Code of Virginia (1950), as amended, and that if the City <br />of Portsmouth subsequently elects to cancel this project, the City of Portsmouth hereby agrees to <br />reimburse the Virginia Department of Transportation for the total amount of the eligible costs <br />expended by the Department through the date the Department is notified of such cancellation. <br /> <br /> ADOPTED by the Council of the City of Portsmouth, Virginia, at a meeting held on <br />October 12, 2004. <br /> <br /> Teste: <br /> <br />City Clerk <br /> <br /> <br />
