(a) The chief` of the Department of Fire, Rescue and Emergency Services may adopt <br />reasonable rules and regulations, not inconsistent with the provisions of this division, for the <br />granting of permits for supervised public displays of fireworks by fair associations, amusement <br />parks and other organizations or groups of individuals. <br /> <br /> (b) A permit referred to in subsection (a) of this section may be granted by the fire <br />marshal upon application therefor and the filing of the bond required by section 13-117. The <br />application shall be made in writing at least thirty (30) days in advance of the date of the display. <br /> <br />Sec. 13-117. Same--Applicant's bond and proof of financial responsibility. <br /> <br /> (a) Each applicant for a permit under this division shall be required to give a bond, in <br />a sum not less than one million dollars ($1,000,000.00), conditioned on compliance with the <br />provisions of this division and the regulations adopted hereunder; provided, however, that no <br />governmental agency shall be required to file such bond. <br /> <br /> (b) Before any permit shall be issued under this division, the person making <br />application therefor slmll furnish proof` of financial responsibility to satisf,y claims for damages to <br />persons or property arising out of any act or omission on the part of such person or any agent or <br />employee thereof, in such amount, character and form as the chief of the Deparunent of' Fire, <br />Rescue and Emergency Services shall determine to be necessary f,or the protection of the public. <br /> <br />Sec. 13-119. Competency of operator; location, composition, etc. <br /> <br /> Every display authorized by a permit granted under this division shall be handled by a <br />competent operator licensed or certified as to competency by the chief of the Department of, Fire, <br />Rescue and Emergency Services and shall be of such composition, character and so located, <br />discharged or fired as, in the opinion of the chief of the Department of Fire, Rescue and <br />Emergency Services, after proper inspection, not be hazardous to property or endanger any <br />person. <br /> <br />Sec. 13-131. Definitions. <br /> <br /> The following words and terms, when used in this article, shall have the meanings <br />ascribed to them in this section: <br /> <br /> Dwelling unit shall mean a single unit providing complete independent living facilities for one <br />(1) or more persons including permanent provisions for living, sleeping, eating, cooking and <br />sanitation. <br /> <br /> Smoke detector shall mean a mechanical device powered by batteries or alternating current <br />capable of sounding an audible alarm upon sensing visible or mvisible products of combustion <br />and which meet the specifications contained in the Virginia Statewide Fire Prevention Code, a <br />copy of which is on file in the office of the fire marshal. <br /> <br /> <br />
