(1) The fire marshai shall investigate or cause to be investigated any reported fire or <br />explosion causing a loss of life or severe injury, or extensive destruction or damage to property, <br />and all offenses involving fires, fire bombings, bombings, attempts or threats to commit such <br />offenses, false aiarms relating to such offenses and possession and/or manufacture of explosive <br />devices, substances and fire bombs occurring within the jurisdiction. Such investigation shall be <br />pursued until its conclusion. <br /> <br /> (2) The fire marshal or any investigator shall immediately take charge of any physical <br />evidence relating to the cause and origin of such fire or explosion and preserve such physical <br />evidence until it has been properly processed. <br /> <br /> (e) Unsafe conditions. The fire official or fire officer in charge shall order the sealing <br />of (thereby preventing the use of) any existing device or appliance including, but not limited to, <br />those of heating, electrical or mechanical nature and components of fuel transportation, storage, <br />distribution and utilization systems, or any other device or appliance found to be defective or in <br />violation of this chapter's requirements for existing appliances after giving notice to this effect to <br />any person, owner, firm, agent or operator in charge of same. The fire official or fire officer in <br />charge may seal any device or appliance without notice when inspection shows the existence of <br />an immediate fire hazard or a condition which may imperil human life. The sealed defective <br />appliance shall remain withdrawn from service until all necessary repairs or alterations have <br />been made. The "sealing" referred to herein shall be accomplished by the placing of a red tag or <br />other notice on the defective device or appliance. <br /> <br /> (f) Unauthorized use of seaied device or appliance. <br /> <br /> (1) It shall be unlawful for any person or user, firm or agent to continue the use of <br />any device or appliance wkich has been sealed or ordered sealed under subsection (e) of this <br />section, unless authority to remove said seal is given by the fire marshal. <br /> <br /> (2) Unauthorized removai or breakage of said seal, tag or notice shall constitute a <br />Class 1 misdemeanor. <br /> <br /> (g) Correction of violation required. The imposition of the penalties herein described <br />shall not prevent the fire marshal from instituting appropriate action to prevent unlawful <br />construction or to restrain, correct or abate a violation, or to prevent illegal occupancy of a <br />building, structure or premises, or to stop an illegal act, conduct business or use ora building or <br />structure in or about any premises. <br /> <br /> (h) Failure to correct violations. If the notice of the violation is not complied with <br />within the time specified by the fire marshal, the fire marshal shall request the City Attorney of <br />the jurisdiction to institute the appropriate legal proceedings to restrain, correct or abate such <br />violation or to require removal or termination of the unlawful use of the building or structure and <br />violations of the provisions of this Code or of any order or direction made pursuant thereto. <br /> <br /> (i) Storage or display in roof-over malls. No combustible goods, merchandise or <br />decorations or vehieles shall be displayed or stored in a roofed-over mall unless approved by the <br />fire marshal. <br /> <br /> <br />
