charge, copies of such fire reports to officials of the city or to other governmental agencies who <br />require the same. <br /> <br />Sec. 13-88. Modifications. <br /> <br /> The chief of the Department of Fire, Rescue and Emergency Services shall have the <br />power to modify any of the provisions of the fire prevention code adopted in this article upon <br />application in writing by the owner or lessee, or his duly authorized agent, when there are <br />practical difficulties in the way of carrying out the strict letter of the code, provided that the spirit <br />of the code shall be observed, public safety secured and substantial justice done. The particulars <br />of such modification when granted or allowed and the decision of the chief of the Department of <br />Fire, Rescue and Emergency Services thereon shall be entered upon the records of the <br />department and a signed copy shall be furnished the applicant. <br /> <br />Sec. 13-89. Additional standards. <br /> <br /> The fire prevention code is adopted in section 13-81 and these additional standards are <br />adopted as follows: <br /> <br /> (a) Inspection by others. The fire marshal may designate such other persons as he <br />deems necessary to make fire safety mspections. Such persons shall use this chapter as the basis <br />for such inspections. <br /> <br /> (b) Impersonations. It shall be unlawful for any unauthorized person to use a badge, <br />uniform or any other credential so as to gain access to any building, structure, marine vessel, <br />vehicle or premises or to otherwise falsely identify himself as the fire marshal or his authorized <br />representative. <br /> <br />(c) Right of entry. <br /> <br /> (1) Whenever necessary for the purpose of enforcing the provisions of this chapter or <br />whenever the fire marshal has reasonable cause to believe that there exists m any structure or <br />upon any premises any condition which makes such structure or premises unsafe, the fire <br />marshal may enter such structure or premises at all reasonable times to inspect the same or to <br />perform any duty imposed upon the fire marshal by this chapter; provided, that if such structure <br />or premises is occupied, the fire marshal shall first present proper credentials and request entry. <br /> <br /> (2) Any person, including the owner, lessee, manager, operator or occupant of any <br />structure or premises, who shall interfere in any way with or deny entry to the fire marshal or his <br />designated representative while in lawful performance of his duty shall be deemed guilty of a <br />misdemeanor. <br /> <br /> (3) When such entry is refused, the fire marshal shall have recourse to any other <br />remedy provided by law or equity to secure entry. <br /> <br />(d) Investigation of fires. <br /> <br /> <br />
