AN ORDINANCE TO AMEND CHAPTER 40 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTIONS 40-22, 40-43.4, <br />AND 40-43.7 AND TABLES 40-43.1.2 AND 40-43.1.3 THEREOF PERTAINING <br />TO YItE USE AND PLACEMENT OF FREIGHT SHIPPING CONTAINERS. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. That Section 40-22 of the Code of the City of Portsmouth, Virginia (1988) <br />be amended and reordained by adding thereto the following definitions of the terms <br />"Freight shipping container" and "Shipping container storage yard." <br /> <br />Sec. 40-22 Specific Definitions. <br /> <br />Freight shipping container. A portable, weather-resistant receptacle designed for and <br />used in multi-modal shipment of goods, wares or merchandise, including a receptacle <br />originally designed for the transport of goods but not currently used for such purposes. <br />Truck or tractor trailers are included in this definition. <br /> <br />Shipping container storage yard. An operation for storage of empty shipping containers <br />conducted as the principal use of the property. <br /> <br /> 2. That Section 40-43.4 of the Code of the City of Portsmouth, Virginia <br />(1988) be amended by adding thereto a new Condition 56 to read as follows: <br /> <br />Sec. 40-43.4. Conditions for specific uses. <br /> <br />(56) Performance Standards - Shipping container storage yards shall meet the <br />following minimum standards. <br /> <br /> a. No shipping container storage yard may be established without an approved <br /> site plan. A container storage plan shall clearly delineate all areas to be used <br /> for the storage of shipping contmners. <br /> b. A shipping container plan shall provide for the following: <br /> <br /> 1. A minimum of a 50-foot drive aisle shall be identified in order to <br /> allow for sufficient space between containers for forklifts and to <br /> maneuver safely. <br /> 2. Containers shall be not be stored in groups greater than 200 feet <br /> by 80 feet. <br /> 3. Containers shall be placed on a level, well-compacted surface of <br /> crush and run or similar material. All entrance drives and off <br /> street parking areas shall be paved with asphalt or concrete. The <br /> container storage area as well as the entrance drives and off- <br /> streel parking areas shall be maintained free of potholes. <br /> <br /> <br />
