c. Shipping containers may be stacked no higher than four (4) containers high <br /> provided that no stacking of containers shall be located within 200 feet of any <br /> residential, commercial, office, business park or light industrial zoning <br /> district. <br /> d. Only shipping containers being used in the active transport of goods, wares or <br /> merchandise shall be placed or stored in a shipping container storage yard. <br /> e. All shipping containers shall be placed or stored in a shipping container <br /> storage yard in an empty and ready to ship state. <br /> f. Only minor repair of the shipping containers shall be permitted on the site to <br /> ensure that the shipping containers remain in a condition ready to ship. The <br /> term "minor repair" shall include cleaning, repairing, servicing, painting or <br /> fumigation of the container units. <br /> g. All shipping containers shall be kept within a fenced area. A 50-foot wide <br /> vegetative landscaped buffer shall be provided around the perimeter of the <br /> site. Fencing shall be opaque and shall have a height of 8 feet. The required <br /> vegetative landscape screening shall be placed between the fence and the <br /> property line. Vegetative screening shall consist of a mix of deciduous and <br /> coniferous trees and shrubs designed to provide intermittent visual <br /> obstructions from the opaque fencing. The trees shall be a minimum of one <br /> and one-half(l-½) inches in caliper, measured at a point located six (6) inches <br /> above existing grade, at the time of planting. The Director of Planning shall <br /> have the authority to modify the buffer requirements during site plan review. <br /> h. The owner/operator shall maintain a log showing the date the container was <br /> brought on the site and the date removed. No shipping container shall be <br /> stored on the site longer than 12 months. <br /> i. No signage shall be placed on the shipping container units. <br /> j. Any visible graffiti on shipping containers that is visible from adjacent <br /> properties or the public right-of-ways shall be removed immediately. <br /> k. All truck chassis must remain in an operable condition, be roadworthy, and <br /> display all valid vehicle license and current tags, as required. <br /> l. The property or site must remain locked after hours or when the property is <br /> unmanned. <br /> <br /> 3. That Section 40-43.7 of the Code of the City of Portsmouth, Virgima <br />(1988) be amended and reordained to read as follows: <br /> <br />Sec. 40-43.7 Open storage; commercial districts <br /> <br /> The outside storage of any equipment, vehicle, materials or supplies in <br />commercial zoning districts shall be permitted only within an area completely screened <br />from view and architecturally compatible with the building(s) on the site. The use of <br />tractor-trailers or metal freight containers for enclosed storage or any use other than <br />transportation of goods is prohibited. <br /> <br /> <br />
