OREIINANCE NO oo -4 <br /> <br />AN ORDINANCE TO AMEND CHAPTER 11 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTIONS 11-3(10) AND <br />(11) AND 11-10(c)(1) THEREOF PERTAINING TO LAND DISTURBANCE <br />PERMITS FOR SINGLE FAMILY RESIDENTIAL LOTS. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. That section 11-3 of the Code of the City of Portsmouth, Virginia, be <br />amended by deleting subparagraph (10) and by amending subparagraph (11) thereof and <br />reordained to read as follows: <br /> <br />Sec. 11-3. ExCeptions from chapter. <br />In no instance shall the provisions of this chapter be construed to apply to the following: <br /> <br />(i) <br /> <br />Such minor land-disturbing activities as home gardens and individual <br />home landScaping, repairs and maintenance work; <br /> <br />(2) Individual service connections; <br /> <br />(3) <br /> <br />Construction, installation or maintenance of electric and telephone utility <br />lines; <br /> <br />(4) <br /> <br />Installation, maintenance or repair of any underground public utility lines <br />when such activity occurs on an existing hard-surfaced road, street or <br />sidewalk provided such land-disturbing activity is confined to the area of <br />the road, street or sidewalk which is hard-surfaced; <br /> <br />(5) <br /> <br />Septic tank lines or septic drainage fields unless included in an overall <br />plan for land-disturbing activity relating to construction of the building to <br />be served by the septic tank system; <br /> <br />(6) Surface or deep mining; <br /> <br />(7) <br /> <br />Exploration or drilling for oil and gas including the well site, roads and <br />off-site disposal areas; <br /> <br />(8) Tilling, planting or harvesting agriculturali horticultural or forest crops; <br /> <br />(9) <br /> <br />Construction, repair or rebuilding of the tracks, rights-of-way, bridges, <br />communication facilities and other related structures and facilities of a <br />railroad company; <br /> <br />( 1 O) Reserved. <br /> <br /> <br />
