ORDINANCE NO. 2003-27. <br /> <br />AN ORDINANCE TO AMEND CHAPTER 40 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTION 40-44.5.1 <br />THEREOF PERTAINING TO THE USE OF BARBED WIRE. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. That Section 40-44.5.1 of the Code of the City of Portsmouth, Virginia <br />(1988) be amended and reordained to read as follows: <br /> <br />Sec. 40-44.5.1. Barbed or razor wire. <br /> <br /> (a) No barbed or razor wire shall be used for the purpose of wholly or <br />partially enclosing any lot or premises, except that barbed ends of fences, barbed wire <br />and razor wire may be used on top of any wall or fence wholly or partially enclosing any <br />lot or premises in any commercial or industrial district, as defined by zoning ordinance, <br />and barbed wire may be used on top of any wall or fence wholly or partially enclosing <br />any public school, park. recreational: or playground site. or any utility facility in any <br />residential, commercial or industrial district; provided, that such wall or fence is at least <br />six (6) feet in height, that the barbed wire or razor wire is installed on arms or brackets <br />extending from the top of such wall or fence inwardly over the private property to be <br />wholly or partially enclosed, that not more than three (3) strands of barbed wire shall be <br />so installed, and the first strand shall be at least six (6) inches from the face of the wall or <br />fence. <br /> (b) Any person violating any provision of this subsection shall be guilty of a <br />Class 4 misdemeanor, and in addition thereto, shall pay the expense of removing the <br />barbed or razor wire from the fence or wail in question. <br /> <br /> 2. That this ordinance shall take effect on the date of its adoption. <br /> <br /> ADOPTED by the Council of the City of Portsmouth, Virginia at a meeting held <br />on April 22, 2003. <br /> <br /> Teste: <br /> <br /> <br /> City Clerk <br /> <br /> <br />
