ZONING AMENDMENT ORDINANCE Z-03-06 BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That the portion of the zoning map attached to and made a part of the City o£Portsmouth Zoning Ordinance which now zones as Residential RM-75 the property described in Petition for Zoning Amendment Number Z-03-06, is hereby mended and changed so as to show said property zoned as Commercial C-I~K (Conditional), and that said property is hereby zoned as Commercial C- 1-K (Conditional). 2. That the property affected by this ordinance by being zoned from Residential RM-75 to Commercial C-1-K (conditional) is furthermore described as follows: Z-03-06 Beginning at the northwest comer of Cherokee Road and Chowan Drive; thence, in a westerly direction 80'+ to a point; thence, m a northerly direction 100'_+ to a point; thence, in an easterly direction 80'+ to a point; thence, in a southerly direction 100'+ to a point of the beginning. 3. That the subject property shall be subject to the following conditions as proffered by the applicant for rezoning: (a) The property shall only be used for a child care center for children between two and twelve years of age, and shall have an occupancy of no more than 14 children at any time. Hours of operation shall be limited to between the hours of 6:00 a.m and 6:00 p.m. (c) Outdoor play hours shall be limited to between the hours of 8:00 a.m. and 6:00 p.m. (d) The outdoor play area shall be enclosed with a fence. (e) A minimum of two on-site parking spaces shall be provided for the center. The center shall be constructed and maintained in accordance with the submitted site and floor plans, identified as Exhibits A and B and attached hereto. (g) Landscaping shall be installed and maintained in accordance with the submitted landscaping plan on file in the Office of Planning and Zoning.
