2002-26 AN ORDINANCE TO AMEND CHAPTERS 7 AND 38 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (1988), BY AMENDING SECTIONS 7- 138(b), 38-40(a)(1) and (a)(3), 38-429(a)(I), 38-83, 38-94(c), AND 38-117(a) THEREOF PERTAINING TO RATES AND FEES FOR WATER AND SEWER SERVICE. BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That Sections 7-138(b), 38-40(a)(1) and (a)(3), 38-42(a)(1), 38-83, 38- 94(c), and 38-117(a) of the Code of the City of Portsmouth, Virginia, be amended and reordained to read as follows: Sec. 7-138. Same-Demolition Permits and inspections. (b) The person obtaining a demolition or moving permit shall be responsible for watertight sealing of the building or structure's sanitary sewer lateral at the curb, at the edge of the street pavement if there is no curb, or at the point of connection to the city installed portion of the sanitary sewer lateral. Such seal shall be constructed with a flexible, expandable synthetic or natural rubber sewer plug specifically designed for such purpose and backed with three thousand (3,000) PSI (minimum) compression strength concrete in accordance with the Department of Public Utilities standards. A fee of $25.00 shall be paid for the inspection of the seal by the city. The responsibility for safeguarding the excavation made for sealing the lateral until inspection and for adequately backfilling, compacting and restoring such excavation after inspection and acceptance shall be borne by the demolition permit holder. The person obtaining a demolition permit may elect to have the city seal the building or structure's sanitary sewer lateral at a cost of $250.00, subject to the availability of city personnel. If such election is made, and if city: personnel are available to seal the lateral and the $250.00 fee is paid, the sanitary lateral sealing inspection fee will be waived. Sec. 38-40. Charges for ownership and maintenance of water connections. (a) (1) For the following sizes of service connection, the indicated charge shall be paid in advance: 1/4-inch service (connection) $500.00 1/4-inch service (connection), developer installed with meter installation by department $200.00 1-inch service (connection) Actual cost of such installation plus 25 % (minimum $750.00)
