Sec. 12.215. Exemptions from requirements of competltive bidding or competitive <br />negotiation--Generally: <br /> <br /> (a) The requirements of this article for competitive bidding or competitive <br />negotiation shall not apply to the following: <br /> (1) Purchases procured under the supervision of the state department for the <br /> visually handicapped or from nonprofit sheltered workshops or other nonprofit <br /> organizations which offer transitional or supported employment services serving <br /> the handicapped. <br /> (2) The acquisition of facilities by an industrial development authority under <br /> the Industrial Development and Revenue Bond Act (Code of Virginia, § 15.2- <br /> 4900, et seq.), and facilities for use by the city, the Commonwealth and its <br /> agencies, or other governmental organizations; provided, that any such facilities <br /> owned by the city, the Commonwealth or its agencies or other public bodies <br /> subject to the Virginia Public Procurement Act shall not be exempt from <br /> competitive procurement requirements. <br /> (3) The procurement of legal services or the procurement of expert witnesses <br /> and other services associated with litigation or regulatory proceedings. <br /> (4) Extending the term of an existing contract or services to allow completion <br /> of any work undertaken or not completed during the original term of the contract. <br /> (5) Purchases for special police work when the chief of police certifies to the <br /> purchasing agent that goods are needed for undercover police work. <br /> (6) The procurement of perishable food; provided; however, that the using <br /> agency or department shall document the prevailing list prices as of the time of <br /> the purchase as part of the contract file. <br /> (7) Administering public assistance programs as defined in § 63.1-87 of the <br /> Code of Virginia, the fuel assistance program or community services boards as <br /> defined in § 37.1-1 of the Code of Virginia may procure goods or personal <br /> services for direct use by the recipients of such programs. Contracts for the bulk <br /> procurement of goods or services for the use of recipients shall not be exempted <br /> from the requirements of procurement provisions. <br /> (8) Contracts for certain essential election materials and services, pursuant to <br /> Chapter 24.2 of the Code of Virginia, are exempted from the requirements <br /> of this article. <br /> <br /> (b) A contract may be awarded without sealed bids or competitive negotiation <br />on the basis of an existing contract previously awarded by the commonwealth or the <br />United States of America, or agencies thereof, for the purchase of goods. <br /> <br /> (c) Sealed bids or competitive negotiation shall not be required under such <br />circumstances as the city council deems to be in the best interest of the city or that <br />competition is not feasible. <br /> <br />Sec. 12-217.
