(a) Upon determination made in advance by the city council and set forth in <br />writing that the purchase of goods, products or commodities from a public auction sale is <br />in the best interests of the public, such items may be procured at the auction. The basis <br />for such determination shall be documented in writing. <br /> <br /> (b) The purchase of goods or nonprofessional services, but not construction or <br />professional services, may be made by reverse auctioning. For the purposes of this section, <br />the term "reverse auctioning" means a procurement method wherein bidders are invited to <br />bid on specified goods or nonprofessional services through real-time electronic bidding, <br />with the award being made to the lowest responsive and responsible bidder. During the <br />bidding process, bidders' prices are revealed and bidders shall have the opportunity to <br />modify their bid prices for the duration of the time period established for bid opening. <br />The provisions of subsection (b) shall expire on July 1, 2003. <br /> <br />Sec. 12-250. Withdrawal of bid due to error. <br /> <br /> (b) The procedure of the bid withdrawal shall be stated as follows in the <br />advertisement for bids: "The bidders, shall submit to the purchasing agent his original <br />work papers, documents and materials used in the preparation of the bid within one <br />business day after the date fixed for submission of bids. The work papers shall be <br />delivered by the bidder in person or by registered mail at or prior to the time fixed for the <br />opening of bids." In either instance, such work papers, documents and materials may be <br />considered as trade secrets or proprietary information subject to the conditions of Code of <br />Virginia, § 2.2-4334. The bids shall be open one day following the time fixed by the <br />public body for the submission of bids. Thereafter, the bidder shall have two hours after <br />the opening of bids within which to claim, in writing, any mistake as defined herein and <br />withdraw his bid. The contract shall not be awarded by the public body until the two-hour <br />period has elapsed. Such mistake shall be proved only from the original work papers, <br />documents, and materials delivered as herein required. <br /> <br />Sec. 12-253. Tie bids. <br /> <br /> (a) In the case of a tie bid, preference shall be given first to goods, services <br />and construction produced or provided by a local bidder from the city. <br /> <br /> (c) In the case of a tie bid to which subsection (a) is inapplicable, preference <br />shall be given to goods produced in Virginia, and goods or services or construction <br />provided by Virginia persons, firms or corporations. Otherwise the tie shall be decided by <br />lot. <br /> <br />Sec. 12-278. Negotiation for professional services. <br /> <br /> (a) Professional services shall be procured by competitive negotiation when <br />the cost of the professional services is expected to exceed $20,000. The purchasing agent <br />and representative of the using agency shall engage in individual discussions with all <br />offerors deemed fully qualified, responsible and suitable on the basis of initial responses, <br /> <br /> <br />
